(...) The report is set against the backdrop of the designation of Derry/Londonderry as UK City of Culture 2013. The experience of that city as City of Culture is used as a case study in relation to the realisation of cultural rights in a post-conflict society. As part of the UK City of Culture initiative, the Commission organised a conference and consultation on cultural rights in divided and post-conflict societies in association with the University of Ulster and in co-operation with the UN Special Rapporteur in the Field of Cultural Rights, Ms Farida Shaheed.

As a result of the occupation, Shusha city and 30 villages of Shusha district were destroyed, 195 innocent civilians were killed, 165 were wounded and 58 persons went missing. (...) Along with being an inalienable part of the internationally recognized territory of Azerbaijan, occupied Shusha city has outstanding historical, cultural, moral and symbolic meaning for the people of Azerbaijan. Occupation of Shusha city - known as “Cradle of the Azerbaijani music”, “Conservatory of the Orient” inflicted heavy damage to the cultural, spiritual and moral heritage of the people of Azerbaijan.

Rappel des faits présentés par les auteurs 2.1 À l’époque où les faits se sont produits, en septembre 1995, le fils des auteurs, Phillip Pestaño, servait comme officier de la marine philippine à bord du navire BRP Bacolod City qui se rendait à Mindanao. Le 25 septembre 1995, ou aux alentours de cette date, le capitaine du BRP Bacolod City a autorisé le chargement de plus de 14 000 pieds − planche de grumes sans documents ni autorisation officiels. Cette nuit-là, la victime a confié à son père que le BRP Bacolod City était un bateau «sale» qui transportait une cargaison illicite, notamment 20 sacs de shabu1 valant près d’un milliard de pesos au marché noir. Cet homme était soupçonné d’être impliqué dans «l’opération shabu» à bord du BRP Bacolod City ainsi que dans la mort de Phillip Pestaño et, avant de mourir, il avait rencontré les auteurs en secret.
