On 12 March 2014, the Auezovskiy district court in Almaty, Kazakhstan, rejected the Applicant’s 2 March 2013 request for reinstatement deadline for objections to the alimony court order of 17 August 2005, and noted that its ruling could be appealed with the Almaty City Court. ... The contested decision was based on the findings of an investigation conducted during December 2009 and January 2010 by the Office of Audit and Investigations of UNDP, which established, inter alia, that the Applicant had submitted falsified information to the New York City Housing Development Corporation (“HDC”). The contested decision was communicated to the Applicant by a letter dated 1 December 2010 and received by the Applicant on 5 December 2010. (...) On 1 November 2009, the Applicant and a close relative submitted a rental application to the HDC for a two-bedroom apartment located in a new housing complex in New York City. In the Applicant’s case, to be eligible for an HDC- financed apartment, she and her close relative were required to show a combined income not exceeding USD134,400. 10.

Due to family reasons, during her tenure, the Applicant regularly travelled between Erbil and Kirkuk cities.3 4. In March 2020, due to the outbreak of the COVID-19 pandemic and a deteriorating security situation in Kirkuk, it was no longer possible for her to move freely between the two cities.4 On one weekend in March 2020, while in Kirkuk with her family, a curfew was announced across the country and checkpoints were established.5 5.

… By memorandum dated 17 October 2011, the Applicant informed the Field Human Resources Officer, Jordan (FHRO/J) that he had been awarded ‘the 2012-2013 Fulbright Visiting Scholar (Post-Doctoral) Research Grant’ and that he had received a letter of invitation from the Provost Office at the City University of New York and the Martin E. Segal Theatre Center to conduct post-doctoral research on American drama and theater during the academic year 2012-2013. (...) However, the Applicant stated: ‘Financially, I cannot manage to take a leave of absence from my job at FESA without pay since the Fulbright postdoctoral scholarship grant will only cover university tuition fees, and accommodation and there are no financial liabilities on the part of the City University of New York.’ … By memorandum to the DUO/J dated 8 March 2012, the Applicant noted that he had not yet received a response to his request for leave and repeated the content of his previous memoranda.

According to the evidence on file, the decision to issue the press release was taken by OHCHR/UNHCR after the Inner City Press and GAP, on 1 February 2017, published a confidential memorandum from the UN Ethics Office. (...) In fact, if any harm was suffered, it was originated by the early articles published by GAP (annex 11 to the Respondent’s reply) and the Inner City Press (annex 13 to the Respondent’s reply). In addition, there is no evidence that OHCHR had access to the details of said Memorandum but only to a redacted version of it, made available by the Inner City Press through a link included in its article of 1 February 2017.
