Article XXVIII(a) includes all types of measures under the purview of the agreement, whether in the form of a law, regulation, rule, procedure, decision, administrative action or "any other form" while its alinea (c) defines measures "affecting trade in services" to include the purchase, payment or use of a service, the access to and use of services offered to the public generally and the presence of persons in the consuming country. (...) The list of sectors in the offers and the schedule of commitments is therefore “positive” since countries include only the ones where some level of commitment will positively apply. (...) The agreement adopts the NAFTA approach, the main commonalities being the following: • Separate Chapters on Investment and Cross-Border Supply of Services; • Separate Chapters for Financial Services; • Separate Chapters for the Temporary Movement of Business Persons; • Possibility of scheduling reservations in regards to all core liberalization principles; • Negative list approach to scheduling.

The view was expressed that preference should be given to short-term practical measures which did not require any legal action. After the adoption and implementation of such measures, and the completion of a testing phase of the changes in place, other reform proposals could still be discussed if further, and possibly more far-reaching, measures were needed. It should be noted, however, that, as in most CoE member states, objective necessities and relevant measures in the effort to combat the ongoing COVID-19 pandemic have markedly slowed the hearing and deliberation of all cases.

National action plans to improve the well-being of indigenous peoples 14. (...) Furthermore, government action for indigenous peoples was not part of a cross- sectoral strategy and indigenous peoples themselves were not sufficiently involved in the design and implementation of the action plans. (...) The Special Rapporteur welcomes the existence of such action plans and strongly encourages the Government to seek greater participation by indigenous peoples in their preparation and implementation, to ensure that the action taken responds, in a culturally appropriate manner, to the actual needs of the populations.

OHCHR (Tistounet) asked about the possibility for TMBs to capitalise on the presence in Geneva for UPR of smaller countries that do not have Permanent Missions there by scheduling its TMB review to coincide? Professor O Flaherty suggested that it might be better for there to be appropriate space between the two processes so that States’ implementation of recommendations can be properly assessed and for follow-up across the procedures. (...) One panellist spoke of UPR as being the best thing that had happened to the treaty body system for years, and, with others, made suggestions as to the effect it might have on the treaty body system. Scheduling should take into account the UPR schedule; treaty body recommendations should become more precise, concrete and implementable, and perhaps be prioritized so as to be picked up appropriately in the process.
