1. (...) The requested study on international trade and illegal trade in ODSs (Ozone Secretariat, 2002b),
which was indeed debated extensively by the Parties and decided upon in Decision XIV/7, includes the
following practical suggestions regarding labelling and customs codes (paragraphs 82 and 83 of the study):
“Labelling
In this chapter we examined various options for improving identification and tracking systems
for ODS mixtures and products containing ODS. In the area of labelling the fo llowing conclusions are
drawn:
(a) For virgin substances, given the wide range of labelling systems already in place and the
relative ease with which they can be falsified, together with the existence of other ways of tracking
movements of ODS such as customs codes and export and import licences, there is no value in trying
to introduce a new, universal labelling system;
(b) For used substances, where the volume in trade is much lower and the problem of illegal
trade is particularly strong, the reverse, however, is true.

Introduction
The Ozone Secretariat in consultation with the Expert Group on Customs Codes of the Montreal Protocol
explained in document ST/SG/AC.10/C.4/2003/3 submitted to the Subcommittee of Experts on the
Globally Harmonised System (SCEGHS) at its 5th Session on 7-9 July 2003 the issues concerning
labelling and identification of ozone depleting substances by customs codes. Labelling and customs codes
are considered to be helpful, in particular, on international trade and illegal trade.
Paragraph 17 of the document of the Ozone Secretariat refers to Decision XIV/8 stating:
“Consideration of the use of the Globally Harmonized System for the Classification and
Labelling of chemicals that deplete the ozone layer”, the Parties note the value that could
be attributed to labelling ODSs under the Globally Harmonized System of Classification
and Labelling of chemicals, such as: providing information with respect to identifying the
safe handling of these substances in trade, in the workplace, and in consumer products.

PROPOSAL FOR AMENDMENTS TO RID/ADR/ADN : TRANSPORT OF RECEPTACLES FOR GASES WITHOUT OBSOLETE/NO LABELS / TRANSMITTED BY THE EUROPEAN INDUSTRIAL GASES ASSOCIATION (EIGA)
This leads to a difficulty since Class 2 pressure receptacles may stay with customers many years,
and an obsolete label would cause a technical breach of regulations when the empty receptacle is
collected for testing and re-use.
1.2. (...) The industry is unable to discover how or why labels become detached from receptacles
while they are in the hands of customers and the fact remains that lost lables are a small but
insoluble problem. (...) The incidence of lost
labels is very small. It is safer for the receptacle to be returned to a plant where the residual
contents can be identified and safely disposed of with the required facilities and expertise than to
attempt either re- labelling or disposal and purging on customer premises.

Some countries (Indonesia, Canada, Bulgaria and Oman) provided
information on the Harmonized System numbers, which are used to classify products for customs
purposes. Some countries have requirements or standards for labelling of equipment (Fiji, the United
States, Bulgaria).
9. (...) labelling scheme requires products manufactured with some ODS to bear ODS labels. (...) MP: The MP does not require hazard labelling. The Meeting of the Parties urged all Parties to
introduce in their national customs classification system separate sub-divisions for the most commonly
traded chemicals, as recommended by the World Customs Organization.
