The federal 1984 Canada Health Act establishes publicly funded health-care insurance to cover medically necessary services provided by hospitals and physicians in the provinces and territories. Section 3 of the Act states that the primary objective of Canadian health-care policy is to protect, promote and restore the physical and mental well-being of residents of Canada and to facilitate reasonable access to health services without financial or other barriers. 30. (...) Other health-care services, such as home care and long-term care, are delivered by a mix of private for-profit, private non-profit and public organizations. Physicians are predominantly “self-employed free agents”, generally paid by the respective government, on a fee-for-service basis, which is negotiated with medical associations, although the use of alternate payment systems such as capitation is increasing. (...) In Quebec, for example, access to the latter requires first seeing a physician. The Special Rapporteur further received information about challenges regarding waiting lists, online registrations to consult primary-care doctors for the first time and changing clinics in Quebec. 38.

We again appeal to you to do your utmost to bring pressure to bear on Israel to allow delegates of the International Committee of the Red Cross to intervene promptly and without delay, accompanied by specialist physicians, to assess the state of health of prisoner Al-Wali and save his life, which is in imminent danger.

Accordingly, mediators should be skilled in and trained for being able to see events from the eyes of all interested parties. This would have a positive impact on the legitimacy of mediators in the eyes of the conflicting parties and lead to better chances of working in line with their suggestions towards the solution of a conflict. (...) Some participants also drew attention to the significance of working with local people who have legitimacy in the eyes of the local people, such as elders or other types of key people in specific cultural contexts, and empowering them.

Another character of the novel, Pyotr Verkhovensky echoes him, talking about the need for universal treason, reporting and spying, and claiming that society does not need talents or greater abilities: “Cicero’s tongue is cut out, Copernicus has his eyes gouged out and Shakespeare is stoned.” This is what our Western opponents are arriving at. Some of the concerns expressed by the Special Rapporteur regarding the procedure established by this law are: (a) The composition of the board – the law provides that the review board will be composed exclusively of three physicians, which raises serious concerns of impartiality, since quite often, physicians are reluctant to question another colleague’s decision regarding the termination of pregnancy; (b) Women’s considerations – the law does not reflect that women’s consideration should be taken into account, even though the judgment clearly requires this;28 (c) Timely decisions – this is critical in the context of termination of pregnancy and the gestational limits the law places on terminating pregnancies, (d) Written decisions – there is no obligation to provide a written decision, or an appeal. (...) A/HRC/14/20/Add.3 GE.10-13402 13 challenge the partiality of an individual physician. The Special Rapporteur calls upon the Government of Poland to enact legislation in compliance with the decision in the Tysiąc case. (...) Numerous reports indicate that some doctors, hospital directors, anaesthesiologists and auxiliary medical personnel such as midwives and nurses invoke the conscientious objection clause in refusing to perform abortions, and do not comply with their legal obligations under the Act of 5 December 1996 on the profession of physician and dentist, to refer women to other providers who will perform the termination of pregnancy.30 52.

Physicians, nurses and midwives – when claiming „conscientious objection“ – have the possibility to refrain from providing health care services, which are against their conscience (if the delay in providing assistance does not result in danger of a loss of life, serious bodily injury or serious health disorder or in other urgent cases). (...) Physicians are also obliged to notify this fact in medical documentation. 9. (...) In the situations involving the circumstances specified in the regulation that raise doubt as to the impartiality or sovereignty of any of the physicians appointed as a member of the Medical Board, a patient or their statutory representative has the possibility to apply for the exclusion of the doctor in question from participating in the proceedings.

As regards the above-mentioned 22 inspections in the SI, it should be clarified that they have been conducted in 2010 in accordance with Order № 523 / 02.03.2010 of the Prosecutor General of Bulgaria by joint teams of prosecutors, representatives of the State Agency for Child Protection, Agency for Social Assistance, Bulgarian Helsinki Committee, local authorities, physicians and psychologists. The purpose of those inspections was to find out any violations committed by officials in the SI and resulting in inflicting death, A/HRC/23/G/7 GE.13-15006 3 physical injury or discrediting of children.
