X’s action

Case No. (...) X made false statements in bad faith, that she engaged in mutual flirting or
welcomed the Applicant’s advances through allegedly unblocking him on Facebook
after initially blocking him, or that she tampered with the content of the Facebook
messages.

To support his
allegations, he attaches pages from Marshall’s Facebook account, which indicate that
Marshall, Boolell, and Adamou were listed as “friends” on Facebook. (...) The Secretary-
General contends that, in this regard, Marshall’s Facebook pages submitted by Luvai do
not constitute evidence, let alone sufficient evidence to support such serious allegations.
(...) What Luvai alleges here is that the Legal Officer who was assigned to this case
before the UNDT is a Facebook “friend” of Judge Boolell, then UNDT President, and of a
few other people who could have been tangentially involved in the issues of the
underlying dispute.

The Chief of
Staff responded to their complaints about the process via a Facebook message that the
allowance decision was final. (...) They did request the Agency to reconsider the decision publicly, and the Chief of Staff
responded via Facebook. They assert they received incorrect amounts of allowances and should
have received salary increases. (...) Although our decision of this appeal does not turn on the
threat to penalise applicants contained in the final sentence of the Facebook post, we note that
it identifies two forensic elements in the case.

This allegation was based on Facebook pages from the account of Chief

certain pages from Facebook showing some UNDT Registry staff, Judge Vinod Boolell

Also on 23 October 2013, the IGO looked at the Applicant’s
personal Facebook account, and noted that the above-referenced picture had been
posted on the Applicant’s “wall” on Facebook. (...) Her explanation that her Facebook account had been hacked was
not considered by the IGO; indeed, she denies having posted the
photograph of her with the Syrian President on her Facebook account
and having commented thereon;
c. (...) The investigation by the IGO was conducted in a fair and transparent
manner, and there are no grounds to support the Applicant’s assertion that
the use of her publicly available Facebook page for purposes of the
investigation constituted a violation of her right to privacy, since access to
her Facebook page was possible as no privacy settings were activated; even
assuming that her assertion that her Facebook account had been hacked was
true, this would not change the outcome of her case;
