Factual background
2.1 The authors claim to be members of a class of 9,539 Philippine nationals who obtained a
final judgment in the United States for compensation against the estate of the late Ferdinand E.
Marcos (“the Marcos estate”) for having been subjected to torture during the regime of President
Marcos.1 Ferdinand E. (...) However, the amounts were not
divided per claimant and it is only after collection (in whole or in part) of the judgement amount

President El Hadj ~uar Bongo of the Gabonese Republic and /1adame Bongo paid a
state visit to the Republic of the Philippines from 8 to 12 July 1976.

reads as follows:
"The Government of the Republic of the Philippines hereby declares
its intention:
(a) To comply with the Declaration on the Protection of All Persons
from Being Subjected to Torture and Other Cruel, InhQman or Degrading
Treatment or PunislLment {General Assembly resolution 3452 (xxx[f;
(b) To implement, through legislation and other effective measures,
the provisions of the said Declaration.

the plight of the more than four million Filipino migrant workers; and counsel to
Filipina victims of sexual slavery (“comfort women”) during the Japanese
occupation of the Philippines in World War II.
(...) Aquino, Jr., who was jailed during the
Marcos dictatorship and whose 1983 assassination triggered the People Power
Revolution that returned democratic government to the country.
(...) Aquino, Jr., Francisco
Rodrigo, Neptali Gonzales, Aquilino Pimentel, Jr. and Jose Yap, among others, he
led the opposition to then President and later dictator Ferdinand Marcos.
With these leaders, Mr. Capulong was arrested upon the declaration of martial
law.

Presidential Proclamation No. 370 of 20 March 1968 Declaring as Subject to the Jurisdiction and Control
of the Republic of the Philippines all Mineral and other Natural Resources in the Continental Shelf
Now, therefore, I, Ferdinand E. Marcos, President of the Philippines, do hereby proclaim that all the mineral and other natural resources in the sea bed and subsoil of the continental shelf adjacent to the Philippines, but outside the area of its territorial sea to where the depth of the superjacent waters admits of the exploitation of such resources, including living organisms belonging to sedentary species, appertain to the Philippines and are subject to its exclusive jurisdiction and control for purposes of exploration and exploitation.
