The Respondent states that, at a session of the GWOPA Steering Committee on 1 and 2 February 2017, the Applicant reported on UN-Habitat’s lack of support to GWOPA and proposed that the alliance be moved from UN-Habitat to UNOPS, without seeking the approval of the Executive Director, UN-Habitat. El-Awar joined the United Nations Human Settlements Programme (UN-Habitat) in 2008 as a Programme Manager with the Global Water Operators Partnerships Alliance (GWOPA), at UN-Habitat’s headquarters in Nairobi, Kenya. … On 5 February 2012, the Chairman of the UPA and National Coordinator of the UN-Habitat Project in Tripoli (the Chairman), wrote to the UN-Habitat Acting Director (“AD”) of the Project Office, requesting UN-Habitat to immediately withdraw [Mr. (...) On 5 February 2012, the Chairman of the UPA and National Coordinator of the UN-Habitat Project in Tripoli (the Chairman), wrote to the UN-Habitat Acting Director (“AD”) of the Project Office, requesting UN-Habitat to immediately withdraw the Applicant from Libya and giving reasons for this request. 11. The Director, ID/OIOS, informed the ED, UN-Habitat, by memorandum of 25 March 2013, that after reviewing the Applicant’s complaint, OIOS had determined that “the matter would be best handled by UN-Habitat” and referred it to UN-Habitat for its attention and appropriate action. 26. On 30 April 2013, the ED, UN-Habitat, informed the Director, ID/OIOS that the matter would henceforth be dealt with by the Legal Office and Method and Oversight Office, UN-Habitat. 27.

By letter of 2 February 2017, the Steering Committee of GWOPA also requested the support of the Executive Director, UN-Habitat, for GWOPA’s institutional transition from UN-Habitat to another UN entity. 7. The Steering Committee also wrote to the Executive Director, UN-Habitat, on 2 February 2017, to request “the support of UN-Habitat in a smooth transition of the Global WOPs Alliance to another UN entity”.

In response to these requests, the Respondent referred to a memorandum dated 25 March 2013 from the Director of the Investigation Division of OIOS to the Executive Director of UN-Habitat stating that the matter would be best handled by UN-Habitat. On 5 February 2012, the Chairman of the UPA and National Coordinator of the UN-Habitat Project in Tripoli (the Chairman), wrote to the UN-Habitat Acting Director (AD) of the Project Office, requesting UN-Habitat to immediately withdraw the Applicant from Libya and giving reasons for this request. 19. (...) The Branch Coordinator (BC) of the UN-Habitat Reconstruction and Rehabilitation Branch discussed UN-Habitat’s role with the UPA in Libya.

Rafael Tuts, the Director, Programme Division, UN-Habitat, informed the Applicant that UN-Habitat had decided to “conduct a management review of GWOPA”. (...) On the same day the Applicant requested suspension, pending management evaluation, of UN-Habitat’s decisions to withdraw his delegation of authority and to remove the majority of his functions. 8. By memorandum of 28 February 2017, the Executive Director, UN-Habitat, reminded the Coordinator, Urban Basic Services Branch, UN-Habitat, of his supervisory role over the Applicant.

On the same day, ALS rejected service of the Application stating: Dear Registry, Kindly be informed that the Secretary-General is represented by counsel at UN-HABITAT in cases brought by former or current staff members of UN-HABITAT. Maimunah Molid Sharif as Executive Director of UN-Habitat. She took up her duties at UN-Habitat on 18 January 2018. (...) On 5 July 2018, the UN-Habitat Administration issued a decision that Mr. (...)
