controlled enterprises or other companies exercising public functions (in situations where their
acts may be attributed to the State) do not refrain from abuse or if the State has laws or policies
which facilitate abuse by business enterprises.17 Furthermore, the treaty bodies suggest that it is
important for States to promote human rights awareness for business enterprises.

example, it provides that the duty to protect includes “the duties of States … to control the
marketing of medical equipment and medicines by third parties”31 and highlights that the State
could violate the duty to protect if among other things it fails to regulate the activities of
corporations; protect consumers and workers; “discourage production, marketing and
consumption of tobacco, narcotics and other harmful substances” and “enact or enforce laws to
prevent the pollution of water, air and soil by extractive and manufacturing industries”.32

Software for genome annotation, gene finding, sequence similarity searches, sequence
alignments and other analytical functions is constantly being improved. Genetic and protein
databases have been growing exponentially over the last few years and protein structural
predictions from sequences have become increasingly possible and more accurate as more
entries are posted in such databases. (...) The targets for new candidate antiviral drugs include inhibition of a number of different
functions: cell entry; viral protease; viral nucleic acid synthesis and processing; regulatory
proteins; and viral release. (...) The structure of many more toxins has now been elucidated, and the different functions of
their sub-units are increasingly known.

“human rights-related due diligence is determined by the context in which a company is
operating, its activities, and the relationships associated with those activities” (para. 25). (...) Pharmaceutical companies have a responsibility to ensure that their medicines are of good
quality, safe and efficacious, for example, they must comply with national and global
manufacturing standards e.g. the current World Health Organization Good Manufacturing
Practice Guidelines.
(...) Because of its critical social function, a patent on
a life-saving medicine places important right-to-health responsibilities on the patent holder.
