This new law specifies that employers may submit for approval to the Ministry of Administrative Development, Labour and Social Affairs the names of workers for whom a “no objection certificate” would still be required, with a justification based on the nature of their work. The number of these workers per company shall not exceed five per cent of their workforce.

Il fallait que les ratifications d’au moins 30 Membres (condition satisfaite depuis le 20 août 2012) représentant au moins 33 pour cent de la jauge brute de la flotte marchande mondiale aient été enregistrées (la condition relative à la jauge brute a été réalisée en 2009) avant d’entamer les 12 mois de délai usuel avant l’entrée en vigueur.
Compte tenu de la nature exhaustive de la convention, et du temps nécessaire pour examiner, mettre en œuvre et renforcer les capacités des Etats de mener des inspections des navires et, le cas échéant, leur délivrer un certificat, les délégués avaient estimé en 2006 qu'il faudrait environ cinq ans pour réunir la formule 30/33.
