In order to deliver justice and uphold the rule of law, the judiciary must be properly equipped and adequately financed. Regrettably, according to the information received during the mission, the percentage of the budget allocated to the judiciary is minimal and far below that of other State institutions. (...) In Punjab, some kind of system of legal assistance was established, but did not work properly in practice because the eligibility criteria were too stringent and the process too lengthy. (...) Although a direct assessment of the functioning of the police falls outside of the prerogative of the Special Rapporteur’s mandate, she wishes to underline that when investigation services fail to properly deliver, they directly and negatively impact the ability of the prosecution services to take cases forward and obtain convictions, consequently impairing the delivery of justice. 75.

The judiciary needs to be given adequate tools, in line with the principles enshrined in the Constitution, to function properly and with legal certainty. 21. The Constitution of the Maldives guarantees a comprehensive set of fundamental rights and freedoms, which include both civil, cultural, economic, political and social rights. (...) The Human Rights Committee also expressed its concern at the composition and functioning of the Commission, stating that it compromises the realization of measures to ensure the independence of the judiciary as well as its impartiality and integrity.9 Because of this politicization, the Commission has allegedly been subjected to all sorts of external influence and has consequently been unable to function properly. While usually such a body should preferably be composed entirely of judges, retired or sitting, some representation of the legal profession or academics could be advisable. (...) To deliver justice and uphold the rule of law, the judiciary must be properly equipped and adequately financed. Regrettably, the percentage of the budget allocated to the judiciary is reportedly minimal and has been facing further reductions every year.

These are serious acts that are tantamount to enforced disappearances and should be properly investigated and sanctioned in accordance with international standards. (...) The Commission referred to the State responsibility to properly investigate these disappearances and to bring perpetrators to justice and made specific reference to the prosecution of military personnel involved in the disappearance of persons who had surrendered to the armed forces. (...) According to several sources, the authorities — in particular the prosecution services — try to discredit disappeared persons by claiming that they have been involved with LTTE, without properly substantiating these allegations. In several cases, the relatives of the victims of enforced disappearance have been subjected to intimidation, threats and reprisals because they insisted that a proper investigation be carried out.
