The Working Group received consistent and recurring
reports that complaints submitted by the victims are not properly investigated and the
defendants are not prosecuted, which has resulted in the loss of public confidence in the
judicial system. (...) Any refusal to do so would be based on their
distrust in the police and the justice system and the fear that they might destroy the
evidence or would not properly investigate the case. Secondly, the Public Prosecutor’s
Office also identified the lack of direct contact with the victims and witnesses as one of the
factors impeding its ability to prosecute crimes.

Indeed, throughout its analysis of the section of “Accountability and access to
justice”, the Report willfully ignores the legal reality which is thoroughly described in
publicly sourced information.2 For instance, the Report castigates Israel for its low
conviction rate for IHL violations (para. 19-20) but fails to properly consider the practical
and legal challenges that Israel faces in conducting investigations in the context of armed
conflicts, which are outlined succinctly in Israel’s comprehensive report about the 2014
Gaza Conflict.3 Even when Israeli concerns are briefly mentioned in the Addendum, they
are summarily dismissed and not taken into consideration, and are certainly not reflected in
the main body of the Report.
(...) The Report’s failure to engage in any serious discussion of the ongoing terrorist
threat which Israel faces, or to even mention the fundamental role that Palestinian
incitement and terrorism play in shaping the reality on the ground is not merely a failure to
properly frame and analyze the status of the implementation of recommendations as this
report purports to do.

REPORT OF THE WORKING GROUP ON ENFORCED OR INVOLUNTARY DISAPPEARANCES ON ITS MISSION TO SRI LANKA
These are serious
acts that are tantamount to enforced disappearances and should be properly investigated and
sanctioned in accordance with international standards. (...) The Commission referred to the
State responsibility to properly investigate these disappearances and to bring perpetrators to
justice and made specific reference to the prosecution of military personnel involved in the
disappearance of persons who had surrendered to the armed forces. (...) According to several sources, the authorities — in particular the prosecution
services — try to discredit disappeared persons by claiming that they have been involved
with LTTE, without properly substantiating these allegations. In several cases, the relatives
of the victims of enforced disappearance have been subjected to intimidation, threats and
reprisals because they insisted that a proper investigation be carried out.
