(') OJ L 182. 19.5.2004, p. 46 27.4.2005 Oficial Journal of the European Union L 106133 H A S AOOmD THIS COMMON POSITION Article I The objective of the European Union shall be to strengthen the international nuclear non proliferation regime by promoting the succwful outwme of the 2005 Review Conference of the Parties to the Treaty on the Non-Proliferation of Nuclear Weapons (NpT). Urging the adoption of measures to discourage withdrawal from the said Treaty 9. d i n g for nuclear cooperation to be suspended where the IAEA is not able to provide adequate assurances that a State's nuclear programme is designed exclusively for peaceful purposes. until such time as the Agency is able to provide such assurances; 10. calling on all States in the region to make the Middle East into an effectively verifiable zone free of nuclear weapons and other weapons of mass destruction and their delivery systems, in keeping with the Resolution on the Middle East adopted at the 1 9 9 5 Review and Extension Conference: 11. since security in Europe is linked to security in the Mediterranean. giving top priority to implementation of the nuclear non-proliferation regime in that region: 12. acknowledging the importance of nudear-weapon-free zons for peace and security, on the basis of arrangements freely entered into beoveen the States of the region concerned: 1 3 . The EU welcomes the action of those of the five nuclear-weapon States which have decreed the relevant moratorium; 37. calling on all States concerned to take appropriate practical measures in order to reduce the risk of acci- dental nudear war: 38. pursuing consideration of the issue of security assurances to the non-nuclear-weapon States Parties to the NET 39. d i n g on nuclear-weapon States to r e a f f i existing security assurances noted by the United Nations Security Council in Resolution 984(1995) and to sign and ratify the relevant pMtocols on nuclear-weapon- free zones, drawn up following the requisite consul- tations. recognising that Treaty-based security assurances are available to such zones: 40. stressing the need for general disarmament 41. highlighting the importance of universal accession and implementation of the Biological and Toxins Weapom ~ Convention (BIVJC), the Chemical Weapons Convention (CWC) and the conventions, measures and initiatives contributing to conventional arms control: 42. calling for universal accession to and effective imple- mentation of the Hague Code of Conduct against Ballistic Missile Proliferation: 43. working for the molution of the problems of regional instability and insecurity and of the conflict situations which are often at the root of armament programmes.

The Special Rapporteur received many reports and testimonies indicating that the Ben Ali regime was marked by widely reported cases of torture and ill-treatment. (...) In the establishments visited, the Special Rapporteur detected dreadful oral hygiene, with multiple and significant dental problems requiring urgent treatment. The accompanying forensic expert did not detect situations of detainees with infectious contagious diseases, such as tuberculosis. 44. (...) CIVIL AND POLITICAL RIGHTS, INCLUDING THE QUESTIONS OF TORTURE AND DETENTION : REPORT / BY THE SPECIAL RAPPORTEUR ON TORTURE AND OTHER CRUEL, INHUMAN OR DEGRADING TREATMENT OR PUNISHMENT, MANFRED NOWAK
Article 52 CC specifies that convicted persons shall serve their terms of imprisonment in correctional facilities of: general or ordinary regime (minimum security), for males convicted of less serious crimes, or females; strict regime (medium and high security), for males convicted of serious crimes and who have previously been imprisoned, and females convicted of grave crimes or recognized as recidivists; or special regime (high security), for males convicted of serious crimes or recognized as recidivists. (...) Of the facilities visited, the Special Rapporteur found Prison No. 421 (Amgalan), ordinary regime, and Prison No. 413 (Zuunkharaa), strict regime, to be generally in line with international standards. (...) Detainees are provided with medical services such as dental prostheses, eye care, cardiograms, various examinations, as well as activities to support the detainees spiritually, with the help of NGOs.

REPORT OF THE WORKING GROUP ON ARBITRARY DETENTION : ADDENDUM
Among other stress factors observed, the delegation notes in particular: (a) The constant “eye” of the surveillance camera (detainees say, “We are totally robbed of privacy”; “We no longer have any control over our lives”); (b) The too-frequent practice of handcuffing, using disposable plastic flexcuffs, of detainees for trips outside the centre, in particular for dental or medical treatment; the detainees say they feel like criminals; (c) The frequent roll calls (four per day on average, including one at night by counting heads in the bedrooms and dormitories). (...) The commercial sanctions regime provided for in the contract, in the form of a point system of penalties having a financial equivalent, derives from the same privatization logic. (...) In certain respects, their regime is less favourable (indeterminate detention; exclusion from legal aid; lack of judicial control of detention; etc.).

While not finding fault with the size of cells and facilities, the Special Rappo r- teur notes with great concern that the pretrial regime is unduly restrictive, including access to and quality of “open” areas. (...) The Special Rapporteur learned that, when detained in a semi-open regime, most inmates sleep in open dormitories and spend several hours a day away from their cell or dormitory. (...) According to Order No . 70, when taking the decision to place a convict in a closed or a high-risk establishment, authorities must bear in mind the threat stemming from the convict, the convict’s pe r- sonality, the severity of the crime committed and relevant negative results of the crime, the convict’s conduct in prison with other inmates and prison staff, compliance with the prison regime, attempts to escape, the convict’s ties with organized crime or terro r- ism, and participation in rehabilitation or resocialization programmes.
