The Independent Expert wishes to highlight some positive financial reforms and measures that were taken: the introduction of new obstacles to corporate shares issued to bearer, the establishment of an obligation for companies to keep accounting books of offshore transactions, the reinforcement of due-diligence requirements on resident agents to identify the real owners of the corporate vehicles for which they provide services, and the regulation and supervision of non-financial actors, such as casinos, Colón Free Zone, accounting and legal firms and real estate, which are now obliged to report suspicious transactions. 42. Tax evasion is a complex phenomenon involving all relevant dimensions of the economy, notably the banking and real estate sectors, the various financial and non-financial intermediaries, accounting and law firms, and free trade zones, with regard to both their national and international activities.

After the mass flight of the Serbian civilian population, an urgent issue for the Government of Croatia was to administer the enormous quantity of abandoned residential property and temporarily allocate these to displaced persons in need of housing. (...) A/HRC/16/42/Add.2 GE.10-18011 13 should not own another residential property or have donated, sold or exchanged a housing unit after October 1991, or have been convicted for crimes against humanity or criminal acts during the war. 43.

Due to the decree of the President of the Russian Federation on the prohibition of people without Russian citizenship owning land in the coastal areas of the occupied Crimea, more than 11 thousand foreigners will lose their lands. (...) The Unified State Register of Real Estate contains information on 11,572 plots owned by foreign nationals on the peninsula.

In 2008, Canada made a historic apology to former students of some Indian residential schools, in which it expressed a commitment to healing and reconciliation with indigenous peoples, and to forging a new relationship in which the Government and indigenous peoples could move forward in partnership. (...) A cornerstone of the Settlement Agreement was the creation of the Truth and Reconciliation Commission to witness the experiences of government residential school survivors, create a complete, accessible and permanent historical record of the Indian residential school system and legacy, and promote public awareness of it. (...) Two thirds of these languages are endangered, severely endangered or critically endangered, due in no small part to the intentional suppression of indigenous languages during the Indian residential school era. The same year the federal Government apologized for the residential school policy, 2008, it committed some Can$ 220 million annually for the next five years to Canada’s “Linguistic Duality” programme to promote English and French.14 By comparison, over the same period, the federal Government spent under Can$ 19 million annually to support indigenous language revitalization.15 2.

During her visit, the Special Rapporteur noted a general problem of access to housing associated with existing housing policies for basic standard dwellings and with real estate speculation. That makes the private real estate market inaccessible to the vast majority of the population. 29. (...) These are new housing units built by a real estate promoter in accordance with fixed technical specifications and financial conditions. (...) Lastly, the Special Rapporteur notes that the programmes to promote housing accessibility and affordability are being conducted at a time of a high vacancy rate in the housing stock (14 per cent nationally, according to official sources, or nearly 1 million units).41 This situation is contributing to the real estate bubble and the explosion in real estate prices.42 C.

Another important provision of the law concerning security of tenure is the recognition of lands traditionally occupied by indigenous peoples (for both residential and agricultural purposes) as the collective ownership of those communities. (...) In 2004, local officials, along with the real estate development company 7NG, began to pressure residents to leave the island, which is to be stabilized and redeveloped as a “satellite city”. (...) In 2004, 8,879 new housing constructions were approved, compared with only 1,182 in 2000.5 As land and real estate became the top sectors of investment before tourism and industry, a new wave of land speculation began to impact dramatically on housing prices. 59.

Furthermore, the petitioners have also drawn attention to the allegedly unlawful conduct of the Miskolc Real Estate Management Ltd. A/HRC/29/NI/1 4 GE.15-09663 (Miskolci Ingatlangazdálkodó Zrt., MIK), and to the human rights obligations of the local government as regards housing, welfare and child -protection. (...) According to the report, a provision of a local government decree which makes the reimbursement payable u p- on the termination of a lease contract with the local government contingent upon the purchase of real estate outside the premises of the municipality (thus quasi condi- tional upon moving out of the municipality) is unacceptable from the point of view of equal treatment. (...) The Commissioner and the Deputy Commissioner have invited the local city coun- cils of the towns of Sátoraljaújhely and Szerencs to immediately repeal the excl u- sionist local government decrees which make the reimbursement payable to the fo r- mer lessor upon the termination of a lease contract with the local government con- tingent upon the purchase of real estate outside the premises of the municipality, and which are in infringement of national law.

Under this programme, 38,000 rental residential units are to be constructed by 2004 in cooperation with the local authorities. (...) To the benefit of the tenants-turned-buyers, the high inflation of the early 1990s virtually wiped out the real value of the mortgage loan granted by the State. (...) However, at the implementation level, the Special Rapporteur was concerned that the information provided to him by the civil society groups reported many instances of forced evictions concerning the Roma people, direct discrimination against Roma in the housing market in the form of real estate advertisements with explicit statements against the Roma and lack of infrastructures and services in Roma communities.
