The Regulations defined a “condominium” as an association of homeowners in a single real estate complex in the housing sector, within the boundaries of which each homeowner has residential and/or non-residential units in apartment buildings and other real estate linked directly to the building, under private, State, municipal or other form of ownership. (...) The Federal Homeowners’ Associations Act, which is currently in force, is designed to: • Normalize property relations in condominiums; • Introduce a procedure for the formation, extension, forfeiture and transfer of rights to real estate in condominiums and its management; • Introduce requirements for State registration of real estate which is the object of property relations in a condominium; • Introduce a procedure for managing real estate in condominiums and for establishing, registering, operating and liquidating homeowners’ associations, as one of the instruments of real estate administration. 13. (...) Accordingly, homeowners’ associations have come to be regarded as groups of homeowners set up for the purpose of managing real estate. A condominium can be composed of several residential buildings which have common property (an integrated system of communications, a plot of land, etc.).

The Group continues to promote activities that can improve the environment for real estate investments and the development of viable real estate markets. Real estate markets are too narrow (too focused on the wealthier groups in society) and undeveloped in most transition economies. The Group is thus identifying real estate projects that require support from the public and private sectors which will deepen real estate markets and make them more accessible to the mass of the population.

Many lack documents proving their property rights; they either lost them during the conflict or never possessed them because they resided in informal properties. In numerous areas, real estate registries have been destroyed , which makes it impossible for Syrians to recover their documentation. Additionally, the Syrian military has closed off certain residential areas, prohibiting civilians to enter without security permits. (...) These laws, such as Law No. 66 of 2012 and Law No. 10 of 2018 , rezone entire residential areas and establish new schemes of construction that do not justly compensate former residents.

Most of the house owners who have built their houses on formal land have court-registered ownership document or uncourt-registered land ownership document which is based on the paper prepared through a real estate shop or community-based land tenure system. (...) Access to water is one of the critical issues in the residential areas on informal land in Afghanistan. The government has extended the city water supply network at very minimum level into some parts of the residential areas located on informal land on hill sites. (...) Sanitation situation is very bad and unhealthy in all residential areas on informal lands. City underground swage canals has not yet made in any city in Afghanistan except in very few towns.

On the other hand, urban design should improve social communication and interaction and facilitate the integration of commercial, institutional and residential facilities. The idea should be to create a more balanced community, as opposed to the dormitory type, with a wide range of community services and infrastructure. Societies which have created internal stability and a functioning market economy recognize that to a great degree this has been achieved thanks to an effective system for registering private land and real estate transfers. Appropriate land administration and land information systems are vital for land management, urban and regional planning, housing, the banking sector, taxation, agriculture and environmental protection. We are all aware that the Working Party on Land Administration provides an effective support to countries of Central and Eastern Europe engaged in establishing land registration systems which will guarantee title to land and real property. The backlog in registration of property rights is a major constraint in the development of effective real estate and housing markets.
