The facts as submitted by the petitioner
2.1 The German cultural journal Lettre International (2009 fall edition, No. 86)3
published an interview with Mr. Thilo Sarrazin, the former Finance Senator of the Berlin
Senate (from 2002 to April 2009, Social Democratic Party) and member of the Board of
Directors of the German Central Bank (from May 2009), entitled “Class instead of Mass:
from the Capital City of Social Services to the Metropolis of the Elite”. (...) Sarrazin received death threats and hundreds of hate e-mails. (...) Assaults on human dignity include, for instance,
degradation, stigmatization or social exclusion30 and other forms of conduct that deny the
affected person’s right to respect as a human being .31

Two days after this
crime an African-American man was attacked in Manhattan by protesters against the
construction of an Islamic community center near Ground Zero in New York.
In August 2010, Mr. Thilo Sarrazin a former high-ranking government official published an
anti-Muslim book entitled "Germany Does Away with Itself" in which he claimed that
“Muslims threaten European societies and that Germans are in danger of becoming
strangers in their own country.” Mr. Sarrazin admitted that his book might encourage racist
and right-wing views. German Chancellor Angela Merkel condemned Mr. Sarrazin’s book,
yet on 18 October 2010 she was quoted saying that Germany's experience to build a
multicultural nation had "failed, utterly failed” thus tremendously boosting an increasingly
hostile public debate about Muslim immigrants in Germany.

Although there had been calls for Germany to make greater use of criminal
prosecution in combatting racism — including by the Committee in its consideration of the
communication concerning Mr. Thilo Sarrazin (CERD/C/82/D/48/2010) — it was
important to respect the fundamental principle of freedom of expression. (...) It was clear that racist comments,
such as those made in the Sarrazin case, could not be accepted. As to the NSU case, he
wondered why the State party avoided describing the crimes committed against members of
different ethnic groups as racism. (...) Sarrazin’s hypotheses had been
positively received and in some cases had been used to justify racist statements.

(...) The Committee has also concluded that the interview with Mr. Sarrazin “contained
ideas of racial superiority.” (...) It is true that, in expressing these ideas, Mr. Sarrazin at times employed denigrating
and offensive language.

Like others, she had been shocked by the
offensive comments made by a public prosecutor about the Committee’s opinion in respect
of the communication concerning Thilo Sarrazin (CERD/C/82/D/48/2010). The official
concerned had been reprimanded and removed from the case and the federal Government
had distanced itself from the remarks, which were in no way indicative of prevailing views
among prosecutors in Germany.
