The courts play a central role in determining women’s ability to enjoy and exercise the rights accorded to them by law. (...) Interlocutors also attribute women’s low rate of election to negative stereotypes and biased presentation of women in the media, which adversely affect both women’s fundraising ability and their political candidacy. The experts consider the objective difficulties women face in raising campaign funding to be a serious limitation on women’s opportunities for political representation, and are deeply concerned that the removal of limits on campaign contributions by the Supreme Court in 2014 threatens to exacerbate this situation. 44.

The Special Rapporteur is furthermore concerned at the ability of a military commission to determine charges in respect of which the death penalty may be imposed.

South Africa, where one in eight children infected with AIDS worldwide lives, has the world’s highest incidence of HIV/AIDS, with a prevalence rate of 10.5 per cent (and 17 per cent for adults aged 15–49 years).10 This has a significant effect on a person’s ability to access adequate food, since HIV/AIDS negatively affects access to employment and income. The current stated Proactive Land Acquisition Strategy of the Department of Rural Development and Land Reform is to buy land on the market and to lease it out to candidate black farmers for a limited period, at the end of which the ability for the lessee to use the land productively is to be assessed. (...) A/HRC/19/59/Add.3 GE.12-10095 11 beneficiaries—moving towards a more bottom-up approach to agricultural support—as well as their ability to deliver results. 28. A rights-based approach requires that the gender dimension be adequately integrated in agricultural policies.

Indigenous people in Congo are limited in their ability to advocate for improvement to their conditions due to their lack of opportunities to participate in decision-making about matters affecting them, from the most basic village level to the national level. 30. Any business based on forest prod- ucts requires a special permit20 that indigenous people cannot readily obtain, in practice, which constrains their ability to pursue economic activities such as harvesting honey, edible caterpillars and raffia. 38. Indigenous tradi- tional pharmacopoeias are also protected (art. 24), and any attempt to limit the ability of in- digenous peoples to practice their traditional medicine is forbidden, with punitive measures established for breach of this prohibition (art. 25). 45.

At its 7th meeting the Board adopted fiduciary standards governing the use, disbursement and reporting on funds issued by the Adaptation Fund covering the following broad areas (refer to Annex 2 for details): (a) Financial Integrity and Management: (i) Accurately and regularly record transactions and balances in a manner that adheres to broadly accepted good practices, and are audited periodically by an independent firm or organization; (ii) Managing and disbursing funds efficiently and with safeguards to recipients on a timely basis; (iii) Produce forward-looking financial plans and budgets; (iv) Legal status to contract with the Adaptation Fund and third parties (b) Institutional Capacity: (i) Procurement procedures which provide for transparent practices, including in competition; (ii) Capacity to undertake monitoring and evaluation; (iii) Ability to identify, develop and appraise project; (iv) Competency to manage or oversee the execution of the project/programme including ability to manage sub-recipients and to support project /programme delivery and implementation.
