The enhanced risk of traffic accidents has been compounded by the larger increase in heavy vehicular traffic (see table 1). (...) The largest increase occurred in accidents involving minor injuries (37 per cent), while accidents resulting in serious injuries increased by only 4 per cent. (...) However, they have not reduced the rate of accidents per 100,000 population, which increased from 317 in 2008 to 328 in 2012.

While the latter Act required accidents to be reported only when human health or environmental risks existed, the Chemical Control Act requires entities handling substances to formulate a risk management plan that includes chemical leakage scenarios, emergency action plans and damage restoration (arts. 4-6). The Government launched “comprehensive plans for safety management of chemical substances” in July 2013.16 As a result, in 2014, an institution responsible for the prevention of and responses to chemical accidents, the National Institute of Chemical Safety,17 was established.

Particularly challenging is the situation in the construction and infrastructure sectors, where large numbers of injuries and fatal accidents occur, in particular in Batumi and Tbilisi, where construction is booming. (...) The Working Group was encouraged by the official figures for 2019, which showed that the number of fatal accidents and of injuries in the workplace had decreased by 24 per cent and 16 per cent, respectively.6 However, the actual figures may be higher as the Working Group learned that many workers did not have proper insurance coverage, which was likely to contribute to underreporting of accidents. 20. (...) According to local trade unions, in A/HRC/44/43/Add.1 11 GE.20-05993 2018, a total of 60 accidents were documented, which resulted in the death of one employee and several serious injuries.

Though the experiences of the Three Mile Island and Chernobyl accidents provided invaluable guidance, a narrow assessment of those accidents would not provide proper guidance for other nuclear accidents.

It has not yet ratified the Chemicals Convention, 1990 (No. 170) and the Prevention of Major Industrial Accidents Convention, 1993 (No. 174). 8. According to article 24(3) c of the new Constitution of Hungary (in force since January 2012), the Constitutional Court may annul any legislation that is contrary to an international agreement to which the State is a party, therefore giving international agreements a constitutional standing.1 Consequently, recognized international human rights norms and international agreements ratified by Hungary become part of the domestic legal order and may be directly applied in national courts; other sources of international law may be directly applicable under national law if enacted through national legislation. (...) Efforts to implement the European directives on waste management include the adoption of European Regulation on chemicals and their safe use (EC No. 1907/2006) and the Regulation on the Classification, Labelling and Packaging of Substances and Mixtures (EC No. 1272/2008).3 In addition, the Seveso Directives III on the prevention of industrial accidents in relation to hazardous substances,4 which were enacted in domestic legislation by Act CXXVIII of 2011 and Regulation 219/2011, require Hungary to establish a policy on prevention of major accidents applicable to industrial establishments where dangerous substances above a certain threshold are used or stored in large quantities. (...) During his visit, the Special Rapporteurs also focused on the issue of industrial accidents with a view to preventing future accidents and to elaborating measures to eliminate or mitigate the adverse impact that such incidents involving hazardous substances have on the enjoyment of human rights, including the rights to health, housing, water and sanitation, the right to food and a safe and healthy environment, and the right to adequate and effective remedy.
