In addition, the Commissioner suggested to the Chief Justice of the Supreme Court that the
plenum of the Supreme Court should consider supplementing its Decision No. 23 of
19 December 2003 on court judgements by adding a provision requiring the ordinary courts,
when settling civil cases, to take account of Constitutional Court rulings containing
constitutional or legal interpretations of the law applied in particular cases.

There are currently around 700
private security companies in the country, many of which are small-scale operations that
provide guarding and detective services.
68. The licensing and registration of private security companies in Austria comes under
the competence of the Ministry for Digital and Economic Affairs, although the Ministry of
the Interior oversees certain aspects, including the vetting of company personnel.

Moreover, the combination of lack of training and highly
inadequate working conditions only exacerbates the pattern of violence and has a direct and
measurable effect, including in terms of military police homicides.
44. Adding to this vicious circle, the Special Rapporteur received reports of cases in
which prison guards had been fired for reporting incidents and replaced by security officers
with two weeks of training.
(...) The effectiveness of such an action is
called into question, however, by the fact that many courts are reluctant to grant relief and,
when they do and State agencies appeal, the appellate process suspends any injunction or
order that may have been issued, adding therefore the many layers of appeal of such orders
available in Brazilian law.

However, despite the positive
expectations and popular support for the proposed changes,46 in its final recommendations
presented in August 2011, the Royal Committee on Constitutional Review did not include
adding the word “gender” to article 6. Despite further lobbying carried out by the women’s
movement at the Parliamentary level, the decision was confirmed by the Cabinet and both
Houses of Parliament, when the Constitutional amendments were passed in September

values, protects under it motherhood and childhood and cares for youth and people with
disabilities and protects them from exploitation.”47 This text further entrenches a traditional
view of women as mothers and as individuals in need of protection.
