Bottles specially designed for breathing apparatus are explicitly included in the scope of Directive 97/23/EC concerning pressure equipment (see article 3, paragraph 1.1 (a)). 2. (...) However, if this initial option was not accepted, a second possible solution would consist in including bottles for breathing apparatus in marginal 201a/2201a for small quantities, as has been done for extinguishers (...) Of these two possible solutions the Commission prefers the first for the following reason: this solution would mean that the requirements of RID and the Annexes to ADR concerning periodic inspections would continue to be applicable to bottles for breathing apparatus. Proposal First option Marginal 212/2212 Paragraph (1) Add the following subparagraph at the end: “- for bottles specially designed for breathing apparatus: Annex I to Directive 97/23/EC(8).”

Sweden considers that breathing apparatus, in meaning of special provision 655, is intended to be used for providing breathable air in a harmful or lethal atmosphere. The expression "breathing apparatus" should therefore not be applicable for breathing equipment used for medical purposes. 4. (...) In special provision 655, add a reference to footnote 4 after "breathing apparatus". The text of the footnote shall read as follows: "A self contained system for providing of breathable air in an immediate danger to life and health atmosphere.".

Justification The requirement for a self contained breathing apparatus may well be appropriate for marine transport but should not be recommended for drivers of transport units carrying dangerous goods by road or by rail. Rather than loosing time and endangering his life whilst putting on the breathing apparatus, a driver should make use of an escape mask and should leave the danger area as soon as possible in case of emergencies involving such dangerous goods. As far as road and rail transport is concerned, a self contained breathing apparatus is reserved for trained fire fighters who can make an approach from outside the scene of the accident.
