On 23 April 2014, the Applicant, a staff member of the Department of General Assembly and Conference Management (“DGACM”), whose office is located in the Albano building (305 East 46th Street, New York), submitted an application, together with annexes comprising almost 350 pages, contesting two decisions of 4 and 16 April 2013 to relocate DGACM staff members to the Albano building and refusing to return staff members already accommodated in the Albano building to the renovated United Nations Secretariat building. 2.

Shabani confirmed in front of MONUSCO security and Monsi that he had used the materials to build his house. MONUSCO security told the Applicant and Shabani to go with Mr. (...) They found the building nails, whereas the cement and wood had already been used in the house construction. (...) Shabani was found with the suspected building materials in a building he was constructing at that time.

On 7 June 2011, she removed an unlocked bicycle belonging to another ICTY staff member, without the owner’s authorization, from the ICTY bicycle parking area and took it to the atrium of the KPMG building (KPMG atrium), a nearby commercial building approximately 50 meters away from the ICTY main building, and left it there. 3. OAI conducted a site visit to a men’s restroom located in the basement of the Salvation Army building, which was used by the event participants according to a building staff.

The Applicant joined the United Nations Economic Commission for Africa (UNECA) in February 1995 as Chief, Building and Commercial Services Unit, Administration and Conference Services Division, at the P-4 level. He subsequently served on a series of contracts with ECA until November 1997, when he received a fixed-term appointment as Chief, Building Management and Commercial Services Unit (known as the Facilities Management Section (FMS)).

The Applicant was recruited as an Expert in National Capacity Building by the Office of the United Nations Development Programme (UNDP) in Kinshasa (Democratic Republic of the Congo), on a fixed-term service contract from 26 March 2009 to 15 April 2010. (...) In his application, the Applicant stated that he had been hired by UNDP on a service contract as a National Expert in Capacity Building. The rules in this case, in particular Article 2.2 (a), (d) and (g)1 indicate that persons recruited under this type of contract are not subject to the Staff Rules and do not have international civil servant status.

The Applicant’s provision of the recommendation letter of 16 June 2015 for AA and DD to a building complex in which she stated her official title as a United Nations official and indicated that she knew DD through her work.
