Bartolomeu is a croupier working in a casino in Portugal. He refused to declare the income resulting from tips received from his customers (casino players) during the fiscal years of 1999 and 2000. (...) However, the Budget Act for 1999, 87-B/98, of 31 December 1998, contradicts this ruling, stipulating in article 29 that sums of money received by casino bank staff from players, depending on their winnings, are considered as gratuities received for or on account of services provided. 2.3 The author considers that this has led to discriminatory practice against croupiers, arguing that it constitutes a violation of the principle of taxing legality, equality and justice. (...) Croupiers are the only staff who are taxed on their tips, whereas waiters working in the same casinos, who likewise tend to receive tips from customers, are not taxed.

The facts as submitted by the authors 2.1 The authors are croupiers working in casinos in Portugal. When the tax authorities demanded payment of their income taxes for 1999 and 2000, the authors refused to declare the income resulting from tips received from their customers (casino players). (...) The city presents as a kind of trilogy: a historical centre with relatively low density; extensive monofunctional areas with modern casinos and shopping centres; and an older, highly-densified multifunctional city. (...) A plethora of jewellers, casinos, designer clothes shops and beauty products are now commonplace – meeting the demands of visitors coming from the Chinese continent. The resident population avoids the historical centre, which is increasingly becoming the backdrop for one-day visits and the occasional photograph on the way to a local casino. Gentrification processes have shifted the relationship between culture and economics in the city, progressively driving out local inhabitants from the historic centre by tailoring the uses of urban spaces to market demands.
