The Independent Expert learned that older persons, including those with cognitive impairments, including dementia, do not qualify for personal assistance under the Act on Disability Services. (...) Older persons with dementia or other forms of intellectual or psychosocial disabilities and cognitive impairments are based in specific units and the Independent Expert witnessed that, in many places, the doors were locked with digital locks and the older persons could not leave the unit or enter the garden when they wanted. (...) Restrictive measures are often targeted at older persons suffering from intellectual and/or psychosocial disabilities and cognitive impairments. When a conflict between an individual’s right to self-determination and safety arises, the Independent Expert recommends the use of alternative measures to best implement the human rights of older persons, without the use of restrictive measures.

Long-term health care in Croatia mainly concerns older persons and persons with intellectual, cognitive or psychosocial disabilities and is mostly organized through the social welfare system and provided in institutional settings. In 2012, in amendments to the electoral law, the right to vote was granted to 18,000 people with intellectual, cognitive or psychosocial disabilities who had been deprived of their legal capacity for decades. The Special Rapporteur was informed that approximately 4,200 people with intellectual, cognitive and psychosocial disabilities still live in institutional care, deprived of their liberty and unable to fully enjoy their rights on equal terms with other members of society.

Witchcraft-related beliefs and practices are too often taken as an explanation for undiagnosed dementia and other cognitive health conditions. Older women accused of witchcraft are at risk of being assaulted and expelled by their families and communities, and even murdered.

The subject of the Operation is the design and implementation of a pilot pre-school education programme through the simultaneous presence inside the classroom of both the kindergarten teacher and an associate member of the minority holding a university degree, with an aim to manage the educational environment effectively through activities that support the cognitive, social and linguistic development of the children, taking advantage of their mother tongue as well.

A significant step which the Government identified needed to be taken A/HRC/33/NI/3 3 GE.16-15955 before ratification was reform of legislation on assisted decision making for those who have an intellectual or cognitive impairment. The Commission welcomes the fact that this legislation has been passed by the Irish parliament, although it still awaits the commencement orders that will permit it to be implemented.

Such impairments may include physical, sensory, and cognitive or intellectual impairments. Mental disorders (also known as psychiatric or psychosocial disability) and various types of chronic disease may also be considered qualifying disabilities.

A 2018 survey led by the Society for Innovation, Technology and Modernisation found that 40% of local council homepages failed basic tests for accessibility for people with sight loss, physical disabilities, cognitive impairment, dyslexia and other accessibility issues.21 Since July 2020, EHRC has partnered with the Central Digital and Data Office (CDDO) to enforce adherence to “The Public Sector Bodies (Websites and Mobile Applications) Accessibility Regulations 2018”.

ACHRA notes the recent report by the Commission into the imprisonment of four Aboriginal men for a number of years in maximum security prisons in the NT, despite having existing cognitive disabilities and otherwise being found unfit to stand trial by reason of insanity.
