The cultural monuments in Kosovo and Metohija represent a unique legacy recognised between World War I and World War II as an integral part of the European heritage. It is important to note that the cultural heritage in Kosovo and Metohija preserved the architecture and, in part, the art of the Roman and Byzantine Empires, the mediaeval Serb state, the Ottoman Empire and more recent Serb and Albanian architecture in an uninterrupted continuum of centuries, which is a unique case in the history of architecture and art; presents the peak of the Byzantine architecture and art; largely integrates the Orthodox Byzantine architecture with that of the Roman Catholics, which is also a unique phenomenon; preserved the monuments and sites that exemplify two centuries (from 1 170 to 137 1) of growth of the medieval Serbia as one of the developed European states; This unique European cultural heritage must be preserved in its original form and, enriched, transferred to hture generations. (...) Moreover, they showed no sign of willingness to carry out this duty effectively. Consequently, this unique cultural heritage was left without proper official care for more than four years.

Modifier la définition de l’information prévue à l’article 2§2.1 de l’avant-projet, en supprimant les qualificatifs « claire, précise et concise » ; le renvoi aux « règles de réaction professionnelle reconnues » constitue un rappel suffisant de la déontologie. 2.2 Recommandations concernant la deuxième section des dispositions générales relatives à la liberté de la presse et de l’édition Renforcer le socle des droits garantis aux journalistes (aux articles 3, 4 et 5) : - Rapatrier les droits des journalistes du statut du journaliste vers le Code de la presse ; - Renforcer l’article 3 de l’avant-projet en prévoyant des limites de la liberté de la presse en consacrant le critère de nécessité comme unique justification des restrictions prévues par la loi et décidées par le pouvoir judiciaire et en supprimant l’expression « d’autres lois ayant un lien avec la presse » (art.3§4) ou en précisant lesdites lois ; - Introduire un article reconnaissant la présomption de bonne foi des journalistes de portée générale ; - Incorporer la question de la sécurité des journalistes à l’avant-projet et consacrer le principe de protection des journalistes dans le cadre de l’exercice de leur profession, afin d’assurer une base législative pour le mécanisme d’alerte rapide et de riposte A/HRC/31/NI/12 GE.16-03032 4 d’urgence pour la protection des journalistes domicilié (le CNDH propose que le mécanisme soit domicilié au niveau de la primature) ; - Reformuler l’article 4§2 de l’avant-projet en stipulant l’obligation de « garantie du droit d’accès à l’information » et ajouter une disposition en vertu de laquelle « l’information doit être délivrée aux journalistes en temps opportun ». (...) S’inspirer des recommandations du dialogue national « Médias et société » pour toute réforme du contentieux de la presse : - Rapatrier dans un code unique (comme le code pénal) toute disposition concernant la liberté d’expression du citoyen et de la presse ; - Consacrer le caractère spécifique de l’exercice de la liberté de l’expression et des médias en interdisant les peines privatives de liberté (outre les violations graves des droits de l’Homme) ; - Privilégier la réparation civile et symbolique et adopter un système d’amendes ; - En cas de supposé délit de diffamation, rendre effectif le recours direct du citoyen (avec l’aide judiciaire notamment).
