That is
worrisome, as migrant populations in the Bahamas include a complex mix of economic
migrants, asylum seekers and refugees, victims of trafficking and other individuals in need
of international protection, such as undocumented and unaccompanied minors and people
of undetermined nationality. (...) The Bahamas is located in a complex migratory environment and exposed to
substantial irregular migration flows.

As well, the negative perception of legal aid
lawyers amongst the detainees, but also in the courts, account for the fact that some detainees,
even juveniles, have waived their right to a public defender and decided to defend themselves
alone, not even knowing the inevitable complexities of criminal procedure. The Working Group
also points out that legal aid is not available for persons detained in the Immigration Act who
would desperately benefit from legal assistance.

Surveillance for the purposes of national security is carried out by a combination of
16 different United States government agencies operating at the federal level subjected to a
complex legal system providing various levels of privacy protection and oversight.
(...) The Intelligence Community in the United States is not left to its own devices. There
is a complex system of oversight of surveillance, both ex ante and ex post. (...) The constant comparisons between the United States and the European Union
are unavoidable, but often unhelpful in that they are often superficial and do not
properly take into account the complexities of the situation. Many people will doubtless
agree with the assessment of the European Court of Justice (Schrems II) that United
States surveillance authorities, including pursuant to section 702 of the Foreign
Intelligence Surveillance Act and Executive Order 12333, create the possibility or
outright permit large-scale surveillance that is not strictly necessary to the needs of the
State.
