There is a need to harmonize cross-jurisdictional coherence in view of the lack of
direct applicability and of full incorporation of the Convention on the Elimination of All
Forms of Discrimination against Women, the lack of a national legal framework on
violence against women and the complex federal system, in which domestic violence laws
and intervention orders fall under the authority of the states and territories.
3. (...) The causes of overrepresentation of indigenous
women in rates of family violence are complex and intersectional, as they face multiple and
intersecting forms of discrimination on the grounds of gender and race.

The identification of missing persons has been hindered by the extensive use of
secondary mass graves, wells and other complex deposition sites during the war; the
advanced state of decomposition of remains; the lack of medical or dental records or

and prioritization of cases between State and entity or district courts (according to which less
complex cases would be transferred from State to entity or district courts), enhancing judicial
and police investigations, and updating witnesses and victim protection measures. (...) The legal framework applicable to war crimes proceedings is complex and unevenly
applied. The Criminal Code of Bosnia and Herzegovina, adopted in 2003, criminalizes crimes
against humanity, and was subsequently amended to bring the definition of torture and other
international crimes into line with international standards, and to define enforced
disappearance as a distinct crime.
