Several interlocutors pointed out that the lack of information on the condition manifests as experiences of stigma in some public spaces. (...) Multiple generations of persons with albinism in Brazil lack information on their condition and on the measures required to prevent sun damage and skin cancer. (...) However, it is important that such information is communicated in a manner that does not reduce albinism to a mere disease to be eliminated, but rather presents it as a condition affecting persons who should be able to enjoy all their human rights.

Various other provisions of the Criminal Code criminalize acts which may fall within the scope of the Convention, and which carry the following penalties: intentional infliction of a severe bodily injury carried out by humiliating or torturing the victim (art. 96.2.8), seven to 10 years' imprisonment; less severe bodily injury by torturing the victim (art. 98.2), three to five years' imprisonment; forcing of testimony by an interrogator or investigator by threat, violence, torture, humiliation, deception or other illegal methods (art. 251.1), up to five years' imprisonment, or five to 10 years in circumstances where there is severe or less severe bodily injury; negligent homicide (art. 94), up to four years' imprisonment; bringing to suicide through brutal treatment or systematic humiliation (art. 95), two to five years' imprisonment; infliction of severe bodily injury by negligence (art. 97), up to two years' imprisonment; intentional infliction of a minor bodily injury (art. 99), three to six months' imprisonment; failure to provide assistance to a patient (art. 106), three to six months' imprisonment; failure to provide assistance to a person who is in a condition endangering his/her life or health (art. 107), three to five years' imprisonment; exceeding of authority by a State official with the use of violence or threat such that it has caused extensive harm (art. 264.2), up to 5 year’s imprisonment; and neglect of duty by a State official causing grave harm (art. 272), three years' imprisonment. 18. (...) The facility was relatively clean, though the toilets and showers appeared to be in poor condition. While there were no allegations of ill-treatment, the main complaints were overcrowding, particularly in relation to sleeping, and the monotonous daily routine of having nothing to do except remain quietly in the courtyard from 7 a.m. until 11 p.m. 45.

Prisoners of war who refuse to answer may not be threatened, insulted, or exposed to any unpleasant or disadvantageous treatment of any kind. 5) Prisoners of war who, owing to their physical or mental condition, are unable to state their identity, shall be handed over to the medical service. (...) In assessing whether an interrogation method is lawful, it is important to take into account the following considerations: A/HRC/46/NI/12 4 GE.21-02445 1) Interrogations must be conducted only by qualified personnel and be subject to strong control mechanisms and oversight to ensure that it does not violate the prohibitions of torture, cruel, inhuman and degrading treatment and any form of coercion. 2) A definitive list of prohibited interrogation techniques is not established, while all possible coercive techniques are prohibited. 3) Individual circumstances of the prisoners of war, including the environment, physical or mental condition of the prisoner, cultural beliefs and sensitivity, gender, age, social, cultural, religious or political background, or past experiences must be taken into account. 4) The totality of treatment since capture must be taken into account, but not only the parameters for interrogation regime or the treatment of the prisoners during the interrogations. 5) Wounded or sick prisoners of war may only be interrogated with the approval of medical staff and such interrogation must not interfere with required medical treatment and must respect applicable standards of medical ethics (attempts to gain information from a prisoner of war through the deliberate denial or protraction of required medical treatment). 6) Interrogation sessions should not take place unless recording methods (audio and/or video) are in operation. 7) Prolonged “incommunicado” in undisclosed locations without access to legal representation or independent mechanisms is prohibited, as it facilitates the perpetration of torture and other cruel, inhuman or degrading treatment or punishment and in itself constitutes a form of such treatment. (...) dl=0) On 27 October 2020, the ECtHR invited Azerbaijan to submit information on, inter alia, the conditions under which Arsen Karapetyan is being held, his medical condition, possibility of exchange of war prisoners.
