The potential impacts of corporations on the enjoyment of human rights have long been recognized within the UN human rights system. (...) In Resolution 8/7, adopted in June 2008,4 the Human Rights Council recognized the need to protect all human rights from abuses by, or involving, transnational corporations or other business enterprises and renewed the mandate of the United Nations Special Representative on the issue of human rights and transnational corporations and other business enterprises (UNSRSG). 3. As regards remedies for abuses by corporate actors of human rights, according to the Special Rapporteur, both agribusiness corporations and States must be aware that, in the absence of appropriate grievance mechanisms, the above mentioned measures may remain ineffective or only partially effective in securing greater enjoyment for human rights.

(...) Switzerland has also begun implementing various measures to avoid profit shifting by multinational corporations, such as action 13 of the Base Erosion and Profit Shifting Project of the OECD. Essentially, “tax proposal 17” aims to keep taxation for multinational corporations and other businesses at low levels to attract businesses to and persuade them to establish their headquarters in Switzerland.

However, at the heart of the current environmental impact assessment system lies an inner conflict of interests that is worrisome: mining corporations are identifying, contacting, contracting and paying private consultancy firms that prepare an assessment to be submitted for licensing purposes, posing serious questions regarding the independence of the evaluator. The delegation of this exercise to private corporations or third parties does not free the State from its obligations under international human rights law, nor is the private actor absolved from applying all the legal substantive and procedural standards enumerated guiding principles on human rights impact assessments of economic reforms.61 50. In parallel, the Independent Expert also recommends that the Government establish a permanent multi-stakeholder platform to channel discussions between mining corporations operating in the country and potentially affected communities.
