In the course of aggressive wars premediatedly started
and dragged on by Armenia since 1988 against Azerbaijan, national cultural heritage
including cultural resources which are not millitary objects has been subjected to attacks
besides residential, educational, industrial and agricultural sites located in Khankendi,
Shusha, Khojaly, Khojavand, Kalbajar, Lachin, Gubadly, Aghdam, Zangilan, Jabrayil, Terter,
Fuzuli and other occupied territories of the Republic of Azerbaijan. The cultural resources
have faced severe damages, theft, vandalism, as well as misappropriation of cultural heritage
resources. They were illicitly transfered from the occupied territories, misappropriated,
modified for the purpose of destruction or concealing the cultural, historical and scientific
essence of it, moreover, the purpose of use of some has been deliberately changed, as a result
of which cultural institutions, real or personal estates that worth billions of AZNs have been
deliberately destroyed by putting fire, blasting or other hazardous ways.

Reaffirming our commitment to the French language and respect for the cultural
and linguistic diversity in our States and Governments, which is the bedrock of the
French-speaking world, and noting that multilingualism is an asset of its people;
6. (...) Aware that digital technology is leading to dramatic changes in the availability and
discoverability of and access to cultural content in the French language, commit to:
(a) Promoting and protecting, online, the diversity of cultural expressions, as
defined by the 2005 Convention on the Protection and Promotion of the Diversity of
Cultural Expressions, in particular through close collaboration between IOF
stakeholders and stakeholders in the digital sphere;
(b) Increasing the discoverability of French-language content online, including
by offering targeted training courses open to the public;
(c) Promoting linguistic diversity online, by striving to contribute to the
projection of an attractive and modern image of the French language, in particular by
promoting the production of appropriate tools and information materials;
(d) Promoting the fair remuneration of creators and rights holders on and by
online content-sharing platforms;
25. (...) Consider the potential of digital technology to become a driver of peace and
security by helping to foster tolerance and fraternal ties in the French-speaking world
and to reduce tensions, protect cultural heritage and resolve international crises by
facilitating contact between people;

III. (...) The Constitutional Court has ordered that the aerial fumigation of illicit crops be suspended
until consultations with the indigenous peoples have led to agreement or eradication
methods that are less detrimental to the indigenous peoples’ survival and cultural
integrity.35 The former Special Rapporteur recommended that there be no aerial fumigation
of illicit crops in the vicinity of indigenous settlements unless the indigenous communities
expressly requested it in full knowledge of the implications.36 The Government has stated
that, pursuant to that recommendation, since 2005 progress has been made with regard to
the right to prior consultation on the eradication of illicit crops, and it has provided detailed

In multiple encounters
with San groups and other knowledgeable sources, it was evident to the Special Rapporteur
that San people continue to maintain a strong cultural attachment to their traditional lands
within the parks.
40. (...) The
Hai//om people were removed from the park in the 1950s, although they still maintain a
cultural connection to lands within the park.12 While previously the Hai//om were permitted
to continue some hunting in the park, following their eviction in the 1950s, all open access
to the park as well as hunting and gathering in it was banned. (...) At the very least,
there is clearly no official policy or activities to reflect the Hai//om connection to Etosha or
to strengthen that connection.

As well as
helping to preserve the cultural wealth of the entire island, the approach taken by the Bi-
Communal Technical Committee on Cultural Heritage may also contribute to overcoming
possibly “over-politicized” interpretations of the situation of historical monuments which
might poison the relationship between the ethnic and religious communities in Cyprus. The
Committee decided to start two restoration pilot projects, agreed to compile a list of the
immovable cultural heritage of Cyprus, and decided to create an educational interactive
programme that would give the younger generation of Turkish Cypriots and Greek Cypriots
the opportunity to learn about each other and the cultural heritage of the island.
(...) The Special Rapporteur would like to stress that freedom of religion or belief
includes the freedoms to worship or assemble in connection with a religion or belief, and to
establish and maintain places for these purposes;10 to train, appoint, elect or designate by
succession appropriate leaders;11 to celebrate holidays and ceremonies in accordance with
the precepts of one’s religion or belief;12 and to establish and maintain communications
with individuals and communities in matters of religion and belief at the national and
international levels.13 In addition, pursuant to article 4 of the 1954 Hague Convention for
the Protection of Cultural Property During Armed Conflict, the High Contracting Parties
undertake to “prohibit, prevent and, if necessary, put a stop to any form of theft, pillage or
misappropriation of, and any acts of vandalism directed against, cultural property”.

In this connection the Government wishes to inform the Special Rapporteur that under
President Uribe the community has been approached with a view to obtaining the permission of
the indigenous authorities for this project, a matter that was fully discussed at a community
council held in Nabusimake.
