Guidance from international human rights bodies suggests that the duty applies to all recognized rights that private parties are capable of impairing and to all types of business enterprises.7 As part of the duty, States are obliged to take appropriate steps both to prevent corporate-related abuse of the rights of individuals within their territory and/or jurisdiction and to investigate, punish and redress such abuse when it does occur - in other words, to provide access to remedy. (...) In each case, provisions and commentary that deal with States’ obligations to provide access to remedy in general are considered, with business-specific references noted at the end of each discussion. (...) A/HRC/11/13/Add.1 page 20 appropriate means, the practical realization” of the principle of non-discrimination between men and women, article 2 (c) requires States “to ensure through competent national tribunals and other public institutions the effective protection of women against any act of discrimination”, and article 2 (b) deals with sanctions against perpetrators. The Convention also specifically refers to business in article 2 (e), under which States parties commit “to take all appropriate measures to eliminate discrimination against women by any person, organization or enterprise”. 37.

Chapter V of the 1992 Constitution of Paraguay, which deals with indigenous rights, was at the time of its writing one of the most progressive legal instruments in existence in terms of the recognition of the rights of indigenous peoples. (...) In addition to INDI, which is the lead agency for indigenous issues, other government bodies deal with issues of importance to indigenous peoples, and some have specific departments for that purpose. (...) The Human Rights Directorate of the Supreme Court also deals with issues relating to access to justice for indigenous peoples and the harmonization of customary and ordinary justice systems.

As for paragraph 7, which deals with the criminal activities through the buffer zone, it should be reiterated that we have repeatedly expressed our readiness to establish contacts at all levels and to cooperate with the Greek Cypriot side in the fight against smuggling, drug trafficking, illegal immigration, human trafficking and similar illicit activity. (...) In spite of the ongoing appeals by the victims and the fact that most of the attacks against the Turkish Cypriots by ultra- nationalist Greek Cypriots occur in the vicinity of the hotel, the Greek Cypriot police still refrain from taking the necessary measures in that area. (...) This is erroneous and unacceptable. The report deals with the issue of missing persons in paragraphs 14-16, in this connection referring to Security Council resolution 1728 (2006) of 15 December 2006 which reiterated its call to the parties “to assess and address the humanitarian issue of missing persons with due urgency and seriousness and welcomed progress made since the resumption of the Committee on Missing Persons (CMP) activities and the appointment of the Third Member of the Committee”.

The experiences of both States and business investors point to the advantages of considering human rights risk early, before projects get underway and before adverse impacts occur. The negotiation is an opportune time to define the expectations and responsibilities of the parties regarding all kinds of risks, including those related to human rights. (...) • The parties need to have adequate expertise in order to identify and manage human rights risks throughout the project and before impacts occur, either by building their internal capacity or by securing external expertise (...) • The level of physical security envisioned for projects has to be carefully considered, and where security is needed, parties should create clear written protocols to manage security provisions, aimed at avoiding and mitigating any related human rights risks and remediating any abuses that occur, including through a credible grievance mechanism.

Before and during his visit to the country, the Special Rapporteur received a great deal of information from non-governmental sources, including personal testimonies from former detainees, to the effect that torture and cruel, inhuman and degrading treatment continues to occur in Spain. (...) The Special Rapporteur received credible information that leads him to believe that, although torture or ill-treatment is not systematic in Spain, the system of detention as it is practised allows torture or ill-treatment to occur, in particular in regard to persons detained incommunicado in connection with terrorist-related activities. According to information received, torture or ill-treatment are most likely to occur during the initial period in police custody.

In 2010, in its general comment on the right to the truth in relation to enforced disappearances, the Working Group expressed its “opinion that no … limitation [to the right to justice] may occur when the enforced disappearance amounts to a crime against humanity” (para. 8). (...) Greater coordination between the SCIT, the Prosecutor-General and the courts needs to occur. The number of prosecutors in the country needs to be increased, and prosecutors also need more expertise to deal with such cases. (...) The PNTL disciplinary and other internal mechanisms must be further strengthened to ensure that disappearances are prevented, and dealt with if they do occur. Effective handling of complaints and officers charged with offences is a key requirement to ensure the credibility of the Force.
