In a letter dated 11 September 2007 to the attention of the Standing Committee of
the United Nations Joint Staff Pension Board (Standing Committee and UNJSPB,
respectively), Laeijendecker reiterated his request for a disability benefit. He maintained
that there were exceptional circumstances that had prevented him from requesting a
disability benefit sooner. (...) He
reiterated his contentions that the ICJ had failed to initiate a disability claim with the
UNJSPF on his behalf, and that he was not aware of the disability claim procedure until
2006. (...) The UNJSPF requests that this Court dismiss the present appeal as there is no
basis for a waiver of the time limit under Administrative Rule H.5(a) for submission of a
request by Laeijendecker for a disability benefit. Laeijendecker presented employment
related issues as justification for the late submission of his disability request, but those
issues would not have prevented him from submitting a disability request in a timely
manner.

On 24 November 2008 Shanks requested the UNJSPB Standing Committee to
reconsider its decision upholding the UNSPC decision to award her a disability benefit.
Shanks produced a medical officer’s report dated 7 April 2006 that was part of the
original submission to the UNSPC for determination of her eligibility for disability
benefits. (...) The initial decision of the UNSPC was that the threshold was met to establish that
Shanks had a disability. This finding was again upheld by the UNSPC when asked to
reconsider its finding. (...) Instead of obtaining a
medical report, Shanks merely reiterated that she disputed the initial finding of
disability. The benefit was suspended for lack of updated medical information.
