WRITTEN SUBMISSION BY THE UNITED KINGDOM OF GREAT BRITAIN AND NORTHERN IRELAND: EQUALITY AND HUMAN RIGHTS COMMISSION (EHRC) AND THE SCOTTISH HUMAN RIGHTS COMMISSION (SHRC) - NOTE BY THE SECRETARIAT
This Bill will allow conditions to be imposed on
processions and assemblies where the noise generated may result in serious disruption. This
new threshold is broad enough to authorise the restriction of protected forms of protest,
including noisy processions, undermining the rights to freedom of expression and assembly
and the protection the courts have accorded to protest which may “disturb, shock or offend
others”. (...) Dunja Mijatović, the Council of Europe High Commissioner for Human Rights, referenced
EHRC’s work on the Bill, calling on the UK Government to focus their “primary attention
on how peaceful demonstrations, even when these cause a certain level of disruption to
ordinary life or express controversial views, can best be facilitated to ensure the full
protection of the exercise of the rights to freedom of expression and assembly.”

General Considerations
The biosecurity measures directed at the prevention of illicit acts should be designed to:
(a) Dissuade these acts;
(b) Detect and impede access that is not authorised or the loss or theft of
materials and biological agents;
(c) Rapidly evaluate the events that could have suggested an irregular situation
and/or the disruption of the biosecurity measures in the facility and in handling the
materials and biological agents in order to permit a swift reaction to mitigate the
corresponding effects;
(d) Make a provision of the elements that may allow a swift response in the event
of a disruption of the biosecurity measures.

Sections 12(1) and 14(1) of the Act enable a senior police officer to impose
conditions on public processions and assemblies respectively, in relation to their time
and/or place/route, when she/he reasonably believes that these will result in “serious public
disorder, serious damage to property or serious disruption to the life of the community, or
are intended to intimidate others”. (...) The Public Order (Northern Ireland) Order 1987, as amended by the Public
Processions (Northern Ireland) Act 1998, provides for police action where public meetings
may cause serious public order problems, serious damage to property or serious disruption
to the life of the community or may aim at intimidating others. (...) Section 11 of the Public Processions (Northern
Ireland) Act 1998 provides that the Secretary of State may impose a ban on a specific
public procession or on all public processions in any area and any period of time not
exceeding 28 days if s/he considers that it is necessary to do so in the public interest to

prevent any serious public disorder, serious disruption to the life of the community, or
serious impact which the procession may have on relationships within the community, or
undue demands which the procession may cause to be made on the police or military
forces.
