The Special Rapporteur received reports that often, caregivers keep the funds for themselves and/or discourage their relatives with disabilities from accessing education and employment in order to maintain such benefits. She was also informed of the situation of mothers who, following a divorce, continue to take care of their children with disabilities, while the father becomes the official recipient of the caregiver benefit. 50. She also urged the authorities to delink a person’s disability status from the reception of social protection benefits, as this generates pressure to reduce the number of persons with disabilities being granted disability status due to the high costs of benefits. 51.

The partial lapse of the statute of limitations should not be applied because, it takes into account the passage of time and thus it essentially has the same legal basis as the statute of limitations. If the effect of the partial lapse of statute of limitations is to preclude effective punishment, as required under the Declaration, it should not be applied. 29. (...) Firstly, the granting of any type of benefit must be subject to effective judicial oversight. Secondly, the particular seriousness of the offence must be considered when deciding to grant benefits. Thirdly, there must be a transparent process which provides appropriate public information on the criteria used for the granting of these benefits and the reasons for their award in each specific case.

This guide is the fruit of that collective experience about how to work towards successful projects that bring benefits to people and appropriately manage any potential adverse impacts on them. (...) As graphically illustrated in Figure 2, integrating human rights at the negotiation will: (1) Facilitate the early identification and early management of potential negative human rights impacts of the investment project; (2) Help establish clear roles and responsibilities for the prevention and mitigation of potential impacts and the remediation of impacts when they occur; (3) Help the parties make appropriate assessments and cost allocations for the prevention, mitigation and remedy of negative human rights impacts; (4) Facilitate cooperation and effective management of issues as they arise throughout the life-cycle of the project (5) Help increase the overall positive benefits of the project, including to human rights. (...) First, they should verify that such arrangements are an effective way of fulfilling human rights given the specific details of each case.

Under the Declaration, States have an obligation to prevent enforced disappearances, by taking effective legislative, administrative, judicial or other measures (art. 3). (...) Article 9 clearly makes the connection between an effective remedy and the protection of economic, social and cultural rights, as it requires an effective remedy not only to determine the whereabouts of the person, but also to determine the “state of health” of the person. (...) Access to justice has a global nature as it extends to the effective exercise of all human rights as a whole.
