In our statement we will focus on the the situation of environmental and human rights defenders
(EHDRs), and the persecution, harrassment and intimidation they may suffer (except SLAPPs), first of
all in the Western Balkan region. We base our findings on the study (draft) Assessment report on the
situation of environmental human rights defenders with particular focus on the Western Balkans,
2021, commissioned by UNEP. (...) The mentioned UNEP report is a very valuable analysis and overview of the situation, covering the last
5 years up to 2021. A similar study following the methodology, would be highly recommended for
other regions to have a full picture of the situation of environmental defenders in the UNECE region.

Environmental situation in the Gaza Strip
1.
By its decision 25/12, the Council/Forum requested the Executive Director to deploy a mission of environmental experts to Gaza to assess the natural and environmental impacts on the Gaza Strip caused by the escalation of violence and hostilities; and requested the Executive Director to submit a follow-up report on the finding, results and recommendations to the Council/Forum at its eleventh special session, in 2010.

Decision 25/12: Environmental situation in the Gaza Strip
The Governing Council,
Recalling decision GCSS.VII/7 of 15 February 2002 on the environmenta1 situation in the occupied Palestinian territories,
Recalling also the desk study on the environment in the occupied Palestinian territories published by the United Nations Environment Programme in 2003 47 and the environmental assessment of the areas disengaged by Israel in the Gaza Strip issued by the United Nations Environment Programme in 2006, 48
Noting with appreciation the participation of the United Nations Environment Programme in the United Nations-led early recovery rapid needs assessment mission carried out from 25 January to 4 February 2009,
Emphasizing the need for States to protect and preserve the environment in accordance with their international legal obligations,
Taking into account the 1992 Rio Declaration on Environment and Development 49 and all its relevant principles,
Expressing its deep concern at the negative implications of the environmental impacts on the Gaza Strip caused by the escalation of violence and hostilities during December 2008 and January 2009,
Expressing great concern about the environment in the Gaza Strip,

This process began with a consultation in Nairobi on 22-23 February 2013 that focused on procedural rights and duties, followed by consultations in Geneva (21-22 June 2013) on the relationship between environmental protection and substantive rights and duties, Panama City (26-27 July 2013) on environmental protection and the human rights obligations related to members of groups in vulnerable situations, Copenhagen (24 October 2013) on how international institutions and mechanisms can integrate human rights with environmental protection and Johannesburg (23-24 January 2014) on constitutional rights to a healthy environment.
(...) Similarly, a “best” approach in one situation may not be considered as successful in another situation.
(...) They might include, for example, efforts to assist communities to participate in environmental decision-making beyond what environmental review laws may require, or even local laws that go beyond national legal obligations.

Background information
The Regional Agreement on Access to Information, Public Participation and Access to Justice in
Environmental Matters in Latin America and the Caribbean ("Escazú Agreement")1 is the first regional
environmental treaty in Latin America and the Caribbean and the first in the world to include specific
provisions for the protection of human rights defenders in environmental matters.
(...) Objectives of the First Annual Forum
The objective of the first forum will be to provide a space for discussion on the situation of human rights
defenders in environmental matters in Latin America and the Caribbean, bringing together the Parties to
the Escazú Agreement, recognized specialists in the field, and the public, especially human rights
defenders, indigenous peoples and local communities, and people or groups in vulnerable situations who
defend the environment.

In order to achieve its objectives, the forum will focus mainly on the following topics:
- The situation and challenges experienced by human rights defenders on environmental issues in Latin
America and the Caribbean.
- Testimonies of human rights defenders

- Mechanisms for the protection of defenders within the framework of the Escazú Agreement and specific
