The major amendment to the Immigration Control and Refugee Recognition Act
in 1990 allowed the Japanese descendents (up to the third generation) to acquire the long-
term residential status without restrictions on employment in Japan. (...) The only possibility for migrants to acquire a regular status is the “special
permission to stay”. (...) She decided that she wanted to continue her education in Japan,
and her parents were eventually deported. This case generated fierce debate in the Japanese
society.

She escaped and went to the police, and it took
11 days for her to be recognized as a victim of trafficking, since she was involved in a
false marriage and had a false work contract; eventually she was assisted and returned
to her country.
(...) In one case, a young Chinese woman who was supposed to be a trainee in a
farm to acquire agricultural skills was taken by the entrepreneur to work as a servant in
her house and raped on a regular basis until she could escape. (...) Children are temporarily released, together with their parents, until the time they
are eventually deported. A new amendment to the Immigration Act that should enter
into force in 2012 will allow undocumented migrants with children to stay in Japan
when certain specific conditions are met.

At the time of his visit, a new
constitution was being drafted, and the Special Rapporteur welcomes indications that the
constitution will eventually include a clear recognition of the right to adequate housing and an
explicit commitment to the reporting obligations of the Government of Kenya under
international human rights treaties.
9. (...) Again, the regulations related to the eminent powers of the State to
acquire one’s property are laid down in the Government Lands Act.
(...) It was also announced
that the settlement was merely a temporary solution and that the population would eventually
be allocated permanent land elsewhere.

Despite the initial substantive budgetary investment40 and the fact that all major real
estate developers joined the programme, it soon became clear that developers had taken
advantage of all the facilities from the State for Rusunami apartments (subsidy and location)
to build middle-class condominiums instead of low-cost apartments. The opportunity to
acquire scarce land within the city limits was probably the main driving force behind the
developers’ interest. (...) Due to the decentralization process, district and municipal Governments now
manage land, determine resource use and spatial planning, and manage revenues and
budgets.73 The Special Rapporteur was informed that in many cases developers acquire
permits for plantation, mining or development activities from local Governments, without
prior knowledge of the residents actually living on the land and sometimes in contradiction
to spatial plan or zoning regulations. 74 Indonesia has witnessed nearly 2,000 cases of
conflicts which involved 600,000 households regarding 10 million hectares of forest land.75

The objectives of this second official visit were to study and acquire a better
understanding of the situation of internal displacement in the Russian Federation, with
particular focus on the situation in the North Caucasus, and to engage in a constructive and
solutions-oriented dialogue with the Government, international agencies, non-governmental
organizations (NGOs) and other relevant actors aimed at ensuring effective responses to internal
displacement. (...) Indeed, the Government had been in contact with the United Nations
Country Team about organizing such a meeting, initially at the working level. The meeting
eventually took place on 9 February 2004. The Representative welcomes this development, and
looks forward to a continued process of consultations.
46. (...) The Representative remained in close contact with the
United Nations Country Team, which raised the issue with the Government, as did UNHCR
publicly in a press release. Eventually, those IDPs who did not wish to return were moved to
one of the remaining camps in slightly better conditions.
