3. On 18 January 2023, the Tribunal invited the Respondent to provide his
comments on the Applicant’s motion to “expand the record”, which he did on 23
January 2023.
4. By Order No. 4 (NY/2023) of 26 January 2023, the Tribunal granted the
Applicant’s motion to expand the record and informed the parties that it would
proceed to adjudicate the matters by Judgment.

Expanded Use of Portable Electronic Devices
In response to queries from States and Industry, ICAO developed Guidelines for the Expanded Use of Portable Electronic Devices (Cir 340) in 2014. This circular provides guidance for States who wish to allow operators to transition to an expanded use of portable electronic devices (PEDs) by passengers during critical phases of flight.
The circular presents the series of considerations that the State should integrate into the approval process, including modifications to regulations and changes in policy and procedures, which should be required of any operator considering or planning to allow the expanded use of PEDs on its aircraft.
Guidance is also provided to assist operators implement the expanded use of PEDs, including:
Technical considerations associated with aircraft PED tolerability testing
Policy and procedures related to flight operations and cabin safety
Crew training
Passenger awareness
