According to reports from non-governmental organizations, over 40 individuals died in prison and detention in 2011.8 One human rights organization met with during the visit reported that in 90 per cent of the cases in which it requested surveillance camera footage from the security facility where torture or death was alleged to have taken place, the response was that the cameras were broken or otherwise non-functional for the period in question. There were also instances where the prosecutor or judge did not seek to have such footage made a part of the case. 33. (...) In addition to preventive monitoring, this also requires a functional mechanism for complaints, investigation and accountability for those violations that occur. (...) However, he is concerned that the commission to be established under this law will not have organizational, but only functional, independence. Chief Inspectors of the Ministry of Interior, for instance, will be in charge of examining the complaints.

Nevertheless, as the Committee on the Rights of the Child recently stressed, concerns about “violent incidents against returnees and displaced persons and their property, memorials or religious objects” remain.23 The Representative was informed of a series of acts of intimidation and harassment of witnesses in war crime trials and regrets the absence of a functional witness protection programme. With large numbers of alleged war criminals still enjoying impunity, the protection needs and safety concerns of these persons cannot be underestimated and often pose a decisive obstacle to them upon return to their communities of origin.

The panel touched upon CEO engagement on human rights, upgraded policy commitments, cross-functional involvement, strong investment in internal capacity-building to support horizontal and vertical coherence, methodologies to apply human rights due diligence, embedding human rights considerations into core processes, and enhancing operational grievance mechanisms. (...) Those tools cover all business processes, the value chain and operational contexts, address the adequacy of current policy and practice, and are based on the Guiding Principles; • To strengthen internal coherence and commitment to action, some companies are hosting cross-functional meetings and workshops or establishing cross-functional working groups or committees; • To build capacity and awareness, some companies are publishing internal guides or developing training modules that address basic definitional questions while using examples and operational language relevant to the business; • To begin to prevent and mitigate adverse human rights impacts, some companies are using a mixture of self-assessments, studies and impact assessments. It was acknowledged that such tensions can exist, and that in order to avoid them as much as possible, it is imperative that the company has cross-functional buy- in, discusses the issues in depth, and addresses the budgeting and resource question up front.
