It was around 2001 when Oxy RB started to manufacture and sell humidifier disinfectant that contained PHMG which had undergone the Government's hazard review for the usage of antimicrobial for carpets but not for humidifier disinfectant. (...) Until 2011, about 600,000 humidifier disinfectants were sold annually. 17. (...) In 2012 and 2013, PHMG, PGH, CMIT and MIT, all of which were ingredient substances of humidifier disinfectants, were designated as toxic substances.

During his visit, the Special Rapporteur was deeply disturbed by the case of “humidifier sterilizers” marketed and sold to consumers in the Republic of Korea without adequate investigation of their risks to human health and life.29 As of December 2015, the Government had recognized that 95 people had died and 221 had suffered adverse health impacts after inhaling hazardous chemicals which were added to humidifier water tanks and then dispersed through the humidifier inside a home environment. (...) Companies were fined by the Government for falsely advertising the humidifier sterilizers as “safe to humans”.32 37. (...) In the view of the Special Rapporteur, Reckitt Benckiser and other companies that sold humidifier sterilizers/disinfectants failed to conduct a reasonable degree of human rights due diligence about the safety of the chemicals in humidifier disinfectants it sold to consumers.

In order to provide support for the deceased and surviving victims of toxic humidifier disinfectants and their families in a timely manner, the Korean government enacted the Special Act on Remedy for Damage Caused by Humidifier Disinfectants in February 2017. (...) The Comprehensive Support Center for Humidifier Disinfectant Damages and the Humidifier Disinfectant Healthcare Center have been operated to provide necessary services such as the submission of damages, subsidy payment, and health management.

It should also provide information about of the penalties imposed on the companies implicated in the deaths of children and adults as a result of toxic humidifier disinfectants in 2016. It would be useful to know whether any law explicitly stipulated that children’s rights should be respected in business activities. (...) When animal testing had identified pulmonary fibrosis in 2011, the Government had ordered a product recall and had recommended that consumers should stop using the product in question until further evidence was available. Tests on six humidifier disinfectants had found substances suspected of causing pulmonary fibrosis in one product, leading to another recall, and companies using fraudulent labelling had been fined. In April 2014, the Government had amended the Environmental Health Act to help victims of the humidifier disinfectants with medical and funeral expenses.

In the same vein, the Special Act on Remedy for Damage Caused by Humidifier Disinfectants came into force in 2017 to provide prompt remedies for victims and their families who have suffered from the use of toxic humidifier disinfectants and prevent recurrence of such tragic case of serious human rights infringement.

These included the cases set out below.7 17. In the humidifier disinfectant case, it is alleged that 1,136 people died and 4,305 suffered ill health owing to exposure to hazardous chemicals found in humidifier sterilizers.8 Since 2011, hundreds of mainly women and children have suffered from respiratory failure, acute pneumonia and other lung diseases as a result of using humidifier sterilizers manufactured and sold by several business entities, including Aekyung Co. (...) It also recommended that the Government should expand support for victims of the deadly humidifier sanitizer and improve the management system, including the assessment of the harmful impact of chemical materials to prevent recurrence of such tragedy. RB Korea (formerly Oxy Reckitt Benckiser) has issued an apology, accepting responsibility for the role that Oxy’s humidifier sanitizing product played and the delay in providing an adequate remedy.10 It has also set up a compensation plan.11 The Working Group heard complaints that it was inadequate in scale and scope. 18.
