The Action Plan to Combat Discrimination on the Grounds of Sexual Orientation, Gender Identity and Expression, and Sex Characteristics establishes concrete measures to be developed in the first four years of implementation (2018-2021) to be revised every four years. It pursues three main strategic objectives: · Promote knowledge on the needs of LGBTI people and on discrimination based sexual orientation, gender identity and expression, and sex characteristics; · Ensure the mainstreaming of policies and measures against discrimination based on sexual orientation, gender identity and expression, and sex characteristics; · Combat all forms of discrimination and violence against LGBTI people in public and private life. (...) Law no. 38/2018 of 7 August, establishes the right to self-determination of gender identity and gender expression, as well as the right to the protection of each person’s sex characteristics.

The identity programs reviewed are mainly government-issued national IDs. (...) Following a brief review of the roles of identity systems in development and recent identity system trends, an overview of the 48 national identity programs, including technical features (such as whether physical identities incorporate an electronic component or are embedded with biometric features), implementation status, population enrollment strategies, and coverage is presented in the report. The implementation challenges around accountability, privacy, data management, enrollment, coverage, cost, and harmonization of identity programs were also reviewed. Finally, the functional applications of national identity programs, reporting how these programs are linked with services in finance, health, agriculture, elections, and other areas, and analyzing whether particular identity program characteristics are associated with functional applications are discussed in the report.

Malta revised its legal gender recognition legislation in 2015 through the Gender Identity, Gender Expression and Sex Characteristics Act (540) and to date around 110 persons, including 2 minors have benefitted from this legislation. a) How are individuals, groups or communities differently affected, based on their sexual orientation and/or gender identity? (...) These include: · The Gender Based Violence and Domestic Violence Act (Act No VIII of 2018). · The Marriage Act and other Laws (Amendment) Act that was introduced in order to remove all distinction between different-sex and same-sex couples before the law (Act XXIII of 2017) · The Affirmation of Sexual Orientation, Gender Identity and Gender Expression Act that was enacted to end harmful practices and affirm that all sexualities and genders are equal before the law (Act LV of 2016) · Two amendments that were effected to the Gender Identity, Gender Expression and Sex Characteristics Act – the first to ensure that the provisions of the Act fully apply to adopted persons (Act XX of 2015) and the second to ensure that the effects of the Act extend to persons in detention (regardless of nationality), as well as depathologise all sexual orientations, gender identities and gender expressions (Act LVI of 2016) · A legal notice introduced in vitro fertilisation (IVF) leave for all couples regardless of their sexual orientation (LN 156 of 2017) · A legal notice introduced the right to convert civil unions into marriage (LN 382 of 2017) · A legal notice introduced ‘gender identity and sex characteristics related conditions’ in the entitlement schedule relative to the National Health Service (LN 44 of 2018). Protection against persecution based on SOGIESC Unlike race, religion, nationality or political opinion, persecution based on sexual orientation, gender identity, gender expression and sex characteristics (SOGIESC) is not explicitly mentioned in Article 1(A)(2) of the 1951 Convention. States have, though, increasingly interpreted the refugee definition of Article 1(A)(2) as including persons fleeing persecution for reasons of their sexual orientation and/or gender identity, inter alia based on the argument that they constitute a social group defined by fundamental immutable characteristics.1 The ECHR does not include the right to asylum.
