3. Data quality
7. The release estimates of unintentional persistent organic pollutants reported by Parties lack
quality assurance and quality control (QA/QC); this has severely limited the assessment for
effectiveness evaluation under Article 16 of the Convention.
(...) The guidelines and guidance on BAT and BEP relevant to Article 5 and Annex C of the
Stockholm Convention

have been, and continue to be, a useful and informative document to assist
Parties in implementing action plans under Article 5 of the Convention.

seekers may be held, from 45 to 50 days. (...) The placement of pretrial detainees and their separation from convicted persons is
provided for in article 11 of the Penitentiary Code and in article 10 of the internal regulations

Article 19 (1) of the Covenant protects everyone’s right to hold opinions without
interference, a right not subject to any restriction. (...) The LDP draft constitutional proposals go even further by allowing for
derogations in times of emergency, beyond what is permissible under international
human rights law.3 The draft proposals would enable the State to restrict certain
human rights in times of emergency, with the caveat that “article 14 (against
discrimination), article 18 (against servitude), article 19 (freedom of opinion),
article 21 (freedom of association and speech) and other provisions relating t o
fundamental human rights shall be respected to the fullest extent. ”4 Although
derogation is permitted under international human rights law in extremely limited
circumstances, the Special Rapporteur is concerned that the proposed emergency
provisions are overly broad. (...) The Government takes a contrary view — expressed in February 2016 by the
Minister of Internal Affairs and Communications12 and confirmed by her subordinates
in discussions during the visit — that, under article 174 of the Broadcast Act, the
Government may order the suspension of a broadcaster’s licence if it determines that
there has been a violation of article 4 of the Act.

The purpose underpinning article 14, paragraph 1 explains why publicity must be more
than formal. (...) Most notably, the death row prisoner has “the right to his conviction and
sentence being reviewed by a higher tribunal” (article 14, paragraph 5, of the Covenant) and “the
right to seek pardon or commutation of the sentence” (article 6, paragraph 4, of the Covenant).

28. Article 15 of the Constitution prohibits slavery and penalizes the selling and buying
of persons. (...) Other relevant laws include the Law for the Integral Protection of the Rights of
Girls, Boys and Adolescents (No. 26.061), which protects in article 9 the child’s rights not
to be subjected to any kind of exploitation;11 and Law No. 25.764 on the National
Programme for the Protection of Witnesses, which is quoted in article 6 (E) of the Law
against Trafficking.12
34. Besides article 145 bis and ter, which specifically criminalize trafficking in persons,
the Criminal Code establishes other penalties for related crimes, some of which were used
by judges and prosecutors prior to the enactment of the anti trafficking law in 2008:
• Articles 119 and 120: Crimes against sexual integrity (Law No. 25.087)
• Article 125 and 125 bis: promotion and facilitation of child prostitution and
promotion and facilitation of corruption of minors
• Article 126: promotion and facilitation of prostitution of others
• Article 127: exploitation of prostitution of others
• Article 128: child pornography (Law No. 26.388)
• Article 140: reduction to servitude
• Article 142 bis: illegitimate deprivation of liberty
