Rather, indigenous peoples and their support organizations, in cooperation with governmental
and other non-governmental actors, should take a leading role in putting these recommendations

several generations of Aboriginal children were compelled to attend schools far from their
communities, leading to widespread psychological suffering, physical abuse and loss of identity.
(...) Despite the Special Rapporteur’s recommendations, judicial processes against Mapuche
activities continued in recent years, leading to further long prison sentences. A new judicial
process initiated in 2005 against members of Mapuche organizations, including some of those
already serving prison sentences, for allegedly engaging in criminal “illegal terrorist
association”, an accusation that became the object of a national and international outcry,
prompted the Special Rapporteur to address an open letter to the President of Chile.

The El Molo and Turkana, who depend on Lake Turkana for their subsistence, have
witnessed the rapid drying out of the lake as a result of prolonged drought and the
damming of the tributary rivers, leading to the depletion of fish and increasing
intercommunal conflicts. (...) In Maasai Mara
the construction of a private tourist resort reportedly associated with top government
officials has involved fencing off an area traditionally belonging to the Sekenani village,
leading to the loss of access to one of the only three sources of water for everyday
human and cattle consumption. (...) In most cases,
these abuses have not been seriously investigated and the victims have found no redress,
leading to a widespread sense that impunity prevails.

Special Rapporteur visited one Mi’kmaq fishing community in Nova Scotia, Indian Brook,
where the Department’s licensing regulations are not in line with the Supreme Court’s ruling on
Aboriginal fishing rights, leading to confrontation between Mi’kmaq fishermen and government
officials, and to renewed litigation. (...) Numerous Aboriginal informants spoke to the Special Rapporteur about the
transgenerational grief suffered because of the loss of culture, identity and meaningful parenting
that has marked community life as a result of the residential school experience, and that may
have been one of the factors leading to the high rate of suicide among Aboriginal adolescents.

Family violence is, as for non-indigenous women, a
leading contributor to homelessness, poverty, criminalization, incarceration, mental and
physical ill health, drug and alcohol abuse, and the removal of indigenous children.18 The
Special Rapporteur notes that the intrinsic link between family violence, child removal and
child protection interventions acts as a significant deterrent for indigenous
victims/survivors to disclose family violence and seek assistance from the support services
that are available. (...) The Special Rapporteur was distressed to hear stories of indigenous mothers who
told her of the perpetuation of negative stereotypes of them, showing a lack of
understanding by practitioners of the underlying causes leading to the removal of their
children. She notes that the 54 recommendations set out in the landmark report of the
National Inquiry into the Separation of Aboriginal and Torres Strait Islander Children from
Their Families, Bringing Them Home, to redress the impacts of the removal policies and
ongoing trauma, have only been partially implemented and remain valid today.21 The
failure to comply with the Aboriginal and Torres Strait Islander Child placement principle
is a major concern.
46. (...) The issue is not addressed adequately in legislation or policy frameworks on
violence against women or women with disabilities, leading to an overall lack of
accountability and impunity for perpetrators.

FrontPage Africa faced another civil suit because of its reporting, leading to the arrest of its
staff and a $1.8 million fine. (...) To avoid excessive fines and de facto criminalization of libel,
the Special Rapporteur strongly recommends that the existing legal framework be amended
to provide for a strict cap on the amount of damages that can be sought in civil libel
lawsuits, in line with the principle of proportionality and the need to ensure that measures
that endanger the financial viability of a journalist or media outlet do not lead to self-
censorship. This would also be in line with the provision in article 21 of the Constitution,
which prohibits excessive penalties.

Reports of human rights abuses against supporters of the deposed
President rocketed after the coup, when the de facto Government suspended civil liberties
and security forces responded to anti-coup demonstrations with excessive force, causing
several deaths and injuries and leading to thousands of arbitrary detentions. Elected
President Porfirio Lobo established a truth and reconciliation commission in 2010 to
examine the events that had occurred before and after the coup. (...) The city of San Pedro Sula, located in the north-west corner of Honduras, grew
exponentially in the late nineteenth century when foreign companies received land and tax
exemptions to settle in the region, leading to the arrival of thousands of Honduran workers.
