The Department of Human Services of the Ministry of Human Development and Social Transformation and the Belize Police Department are the leading institutions mandated with directly processing and assisting victims or potential victims of trafficking. (...) The Special Rapporteur also learned that sting operations are sometimes botched through the complicity of officials, leading to mistrust and complicated rescue plans to avoid leaks. 38. (...) The standard operating procedure does not clearly define the role of the Department of Immigration in detecting and referring cases of trafficking, whereas it should be one of the leading institutions involved and trained in recognizing victims.

The definition of the principles, objectives and strategies concerning the management and use of water resources and the collection and treatment of wastewater falls within the competence of the Ministry of the Environment as the leading agency for the water sector. However, Costa Rica has not yet elaborated and implemented a comprehensive national strategy for the sustainable management and use of water resources, and water and sanitation policies are currently spread over a wide number of laws, regulations and policy documents.5 5 See Contraloría General de la República, Informe sobre la Evaluación de la Aplicación de Políticas y Normativa en Materia de Recursos Hídricos por el Ministerio del Ambiente y Energía, 2007. It also recognizes that the Ministry of the Environment, as the leading ministry in the water sector, is responsible for the definition of the principles, policies and strategies concerning the management and use of water resources, which should be implemented in an integrated, decentralized and participatory way. 26. (...) The Constitutional Chamber (Sala Constitucional) of the Supreme Court of Justice has the primary function of ensuring the protection of the fundamental rights embodied in the Constitution or in international human rights treaties to which Costa Rica is a party.7 Since its creation in 1989, the Constitutional Chamber has produced an impressive body of jurisprudence, and has played a leading role in safeguarding human rights at the domestic level.

During his visit, the Special Rapporteur heard about and witnessed the extensive damage inflicted on Saint Vincent and the Grenadines by flooding, droughts, landslides, rising sea levels, saltwater intrusion and ecosystem changes, leading to massive blooms of noxious sargassum seaweed and the bleaching of coral reefs. (...) Rapid urbanization is leading to increased demand for housing, infrastructure and public services. (...) Housing quality is poor in such areas, increasing vulnerability to climate-related natural disasters and access to water and sanitation is limited, leading to pollution. The joint monitoring programme of the World Health Organization and the United Nations Children’s Fund (UNICEF) estimates that 3 per cent of the population may still be relying on open defecation because of lack of access to toilet facilities.30 The Government is attempting to assist residents living in these challenging situations. 49.

(...) “Truth trials” — judicial procedures attributing guilt or innocence, but with no actionable sentence attached to them — have been followed by regular trials leading to 176 decisions sentencing 695 members of the armed forces and the police, and absolving 74.1 Even with no official vetting programme, citizens and the State have found other ways to indirectly vet security forces.

A general feature of the cases presented to the Working Group is a lack of human rights due diligence in the form of adequate prior consultation with affected communities, leading to “lose-lose” situations of social conflict, human rights abuse, reputational damage for companies and financial losses for investors. (...) On 6 August 2014, Buenavista del Cobre, a subsidiary of Grupo México, spilled 40,000 m³ of copper sulphate and heavy metals into a stream leading to the Sonora River. This environmental disaster affected approximately 22,000 people directly, including through its impact on livestock and crops, and 250,000 people indirectly, from seven municipalities located on the banks of the Sonora River: Arizpe, Banamachi, Huepac, Aconchi, San Felipe, Baviácora and Ures. 46.

The kafala system enshrines the power imbalance between employers and employees, leading to forced labour and exploitative practices, such as wage theft, unfair dismissals, overwork, restricted movements and violence. Those interest rates were already deemed above market by the IMF in 201657 and represented windfall profits to the recipients to an equivalent of 10 per cent of GDP.58 While this operation arguably strengthened the capital buffers of banks,59 it weakened the financial stability of the banking sector by generating significant losses on the BDL balance sheet, ultimately leading to the currency collapse and depositor wealth destruction. Brazil has been leading in the adoption of anti-discrimination laws and special measures12 for the protection of persons affected by Hansen’s disease and their family members. (...) Moreover, anticipated stigma seems to act as a barrier for the full participation of persons affected by Hansen’s disease in community life and society at large, leading to self- isolation, loss of self-esteem and deterioration of mental health.
