The Tribunal notes that staff rule 1.3(b) provides that “the Secretary-General shall seek to ensure that appropriate learning and development programmes are available for the benefit of staff”. (...) Considering that learning and development opportunities are for the benefit of the staff members under the Staff Regulations and Rules, which form the terms and conditions of the Applicant’s employment, the decision relating to learning and development opportunities is therefore an administrative decision subject to judicial review. Whether the Applicant is eligible or not for a learning opportunity is a question for the merits and has no bearing on receivability.

While it is true that the UNAT consists of experienced and knowledgable judges, learning is an on-going and essential judicial requirement and I suggest it would be a bold judge now who claimed to know everything there was to know about the law and had no need of further open-minded learning. 10. The opportunity to consider and learn more from experienced and knowledgable counsel and their clients can usually only benefit the Tribunal: at the very least it cannot reduce the quality of its decision-making.
