Social insurance schemes consist of mandatory pension and invalidity insurance, mandatory health insurance, unemployment insurance and parental protection insurance. (...) The pension system is currently based on three pillars complemented by the provision of social assistance in order to ensure a basic safety net for people in need, namely the mandatory earning-related pillar of the pension; the private pension plan, which is voluntary for private sector employees and mandatory for public employees and persons employed in arduous occupations; and individual savings in pensions and life insurance vehicles. Premiums paid to the third tier are subject to a tax relief. 34. (...) The Independent Expert calls on the Government to ensure availability and accessibility of palliative care for all older persons in need, particularly those who suffer from a life-threatening or life-limiting illness to ensure their well-being and allow them a life with dignity.

The single insurer in this scheme is the Croatian Institute for Health Insurance, established in 1993 to provide universal health insurance coverage to the whole population, based on a benefits package defined under the Mental Health Insurance Act scheme. A/HRC/35/21/Add.2 GE.17-06855 8 addition, supplemental health insurance is available and is purchased individually and on a voluntary basis, from either the Croatian Institute for Health Insurance or private insurers, mostly to cover user charges in the Mental Health Insurance Act system.

Most notably in this regard is article 25 of the Charter of Fundamental Rights of the European Union, which calls on member States to recognize and respect the rights of the elderly to lead a life of dignity and independence and to participate in social and cultural life. (...) It seeks to guarantee and to improve the quality of life of older persons and to ensure their active involvement and participation in all spheres of life. (...) The principle of statutory health insurance, together with the co-insurance dependents (children and non-working partners), ensures coverage of 99.9 per cent of the population.

Costa Rican society is in the advanced stages of demographic transition, characterized by a narrowing of the base of the population pyramid and an increase in older segments resulting from the combination of a low birth rate and high life expectancy. Women have gone from having an average of 2.12 children in 2003 to 1.76 children in 2014,1 and life expectancy, which stands at 79 years,2 is one of the highest in Latin America. 4. (...) In order to implement current laws, the National Council has two programmes under way: “Ageing and quality of life” and “Building solidarity”. The former consists of awareness-raising and training campaigns carried out in conjunction with academia and of coordinating support networks. (...) Social welfare and the right to social security 33. The Social Insurance Fund of Costa Rica is the autonomous institution responsible for managing and governing social and health insurance.

In May 2013 the Tasmanian Anti-Discrimination Commissioner concluded an investigation into the practice of insurance companies excluding or restricting insurance cover to volunteer workers on the basis of their age.

The purpose of the visit was to monitor and assess steps taken by that country to protect human rights implicated by the management of hazardous substances and wastes throughout their life cycle. 2. The Special Rapporteur wishes to thank the Government of the Republic of Korea for its invitation and the effort made to facilitate meetings with government authorities. (...) The Special Rapporteur underlines the State’s obligation to protect and realize the rights to life and to enjoy the highest attainable standard of health. (...) This domestic decision, pending appeal, diminishes the State’s obligation to respect, protect and fulfil human rights, in particular, the duty to take measures to protect the rights to life and health. The judicial enforcement of human rights is fundamental, specifically the obligation of the Government to protect all persons from acts of private parties that impair the full enjoyment of human rights.

In a 2018 decision made under the complaint procedure of the International Covenant on Civil and Political Rights, the Human Rights Committee stressed that, while the Covenant did not protect the right to health as such, the right to life, could not be properly understood in a restrictive manner and its protection required positive measures by the State.13 The Committee recalled that the right to life extended to reasonably foreseeable threats and life-threatening situations that could result in loss of life. States were therefore obliged to adopt health-related positive measures even if such threats and situations did not result in loss of life. At the minimum, States must provide access to existing health-care services that were reasonably available and accessible when lack of access to health care would expose a person to a reasonably foreseeable risk that could result in loss of life. 24. Finally, the Committee concluded that the denial of health-care coverage to an undocumented migrant under the Interim Federal Health Program for immigrants violated the migrant’s right to life (article 6 of the International Covenant on Civil and Political Rights).
