The sharia courts also discriminate against women: divorce proceedings are more difficult for women as compared with men; women who remarry after widowhood or divorce may lose custody of their children; widows are only entitled to half of the inheritance from their husbands; and polygamy, although prohibited, is not prevented in practice in some communities. The first wife is unlikely to ask for divorce, due to the cultural shame, the fear of losing her children38 and the fear of retribution or isolation from the community itself.39 Groups of women particularly at risk 41. The Special Rapporteur also notes that women face discrimination in the areas of inheritance and divorce and that some women may not leave situations of violence because they fear losing custody of their children. The westernized and oppressive nature of the Shah’s regime, and the concern of women as well as men that the country as a whole was losing its moral standards,3 provoked a backlash in the country. (...) With the intervention of the Expediency Council 16 of the proposed bills eventually became law, but only after being amended to lose their progressive elements. These bills, for example, allowed unmarried women to study abroad, raised the minimum age of marriage for girls from 9 to 13, granted women custody rights for sons up to the age of 7, and improved the rights to divorce for women. (...) Women who have been subjected to violence frequently do not want to risk losing their children and, when faced with such a possibility, they often feel they have no choice but to remain in a relationship with a violent partner.

With a national prevalence of less than 10 per cent, underweight in Azerbaijan is categorized as of low public health significance according to the WHO classification.27 70. (...) The prevalence of anaemia among pregnant women in Azerbaijan is a key contributor to the nearly 1 in 10 children born with low birth weight and an estimated 4.9 per cent of children aged less than five who are underweight.30 That should be considered a public health problem that can be solved with a healthy, diversified diet, without medicalization of the food system.

This “multidimensional” poverty measure gives weight to several indicators of poverty, including in relation to housing conditions (habitability, access to water and sanitation, and the surrounding environment) and social cohesion and networks.7 According to that measure, it is estimated that in 2015 over 3.5 million people or 20.9 per cent of the population was poor. Inadequate urban planning and zoning have given more weight to land in terms of profit, rather than in terms of its social functions or its centrality for residential housing.27 The complexities of land regulation go beyond the purview of the present report, however it should be noted that land regulation involves four levels of government, from district to national, and a host of legal instruments and measures, all of which makes for a cumbersome and difficult process, including when trying to develop policies to protect the right to housing for vulnerable groups.28 Municipalities and real-estate developers use the complexities of land regulation to their advantage, often refusing to accept social housing projects in their districts to avoid a loss of tax revenues, or using specific regulations to protect the socioeconomic character of their communities. 34.
