Official Journal - 4 - Item 1839 23) petroleum refineries excluding installations for the manufacture solely of lubricants from petroleum, and installations for the gasification, degasification or liquefaction of coal or bituminous shale at a rate of not less than 500 tonnes per day; 24) extraction from a deposit, including by means of boreholes, or processing: a) gas in quantities greater than 500 000 m3 per day, b) crude oil or its natural derivatives in quantities of more than 500 t per day, c) oil, its natural derivatives and gas - in the maritime areas of the Republic of Poland; 25) the extraction of asbestos or installations for processing asbestos or products containing asbestos in the case of asbestos: a) asbestos-cement products in a finished product quantity of not less than 200 t per year, b) friction material in a finished product of not less than 50 t per year, c) other products containing asbestos in a quantity of not less than 200 t per year; 26) installations for the processing of minerals, other than natural gas, crude oil and natural derivatives thereof, situated in an opencast mining or quarrying area of not less than 25 hectares; 27) extraction of minerals from a deposit by means of: a) opencast mining on an area of not less than 25 ha, b) an underground mine with an output of not less than 100,000 m3 per year; 28) exploration, prospecting and mining of radioactive ores; 29) railway lines which are part of the rail transport infrastructure of the trans-European transport network referred to in Regulation (EU) No 1315/2013 of the European Parliament and of the Council of 11 December 2013 on Union guidelines for the development of the trans-European transport network and repealing Decision No 661/2010/EU (Official Journal of the EU L 348 of 20.12.2013, p. 1, as amended3) ); 30) aerodromes with a basic runway length of not less than 2100 m; 31) motorways and motorways; 32) roads other than those mentioned in point 31 o f n o t less than four lanes and not less than 10 km long at any one section, and the realignment or extension of an existing two-lane road to at least four lanes over a length of not less than 10 km at any one section; 33) ports within the meaning of Article 5 (1) (3) of the Act of 21 December 2000 on inland navigation (Dz. (...) Official Journal - 6 - Item 1839 (2) Projects which may always significantly affect the environment shall also include projects consisting in the extension, reconstruction or assembly of projects already carried out or completed listed in 1) paragraph 1, where that extension, reconstruction or assembly reaches the thresholds, if any, specified in paragraph 1; 2) § 3(1), if that extension, reconstruction or assembly results in the thresholds set out in paragraph 1 being reached, where specified; 3) § 3(1) and which do not meet the thresholds referred to in § 3(1), insofar as they have been determined, if this extension, conversion or assembly results in the thresholds referred to in paragraph 1 being met. § 3. 1. projects which may potentially significantly affect the environment include the following types of projects: 1) installations for the manufacture of products by mixing, emulsifying or concentrating chemical intermediates or basic products; 2) installations for gasification, degassing or liquefaction of coal or bituminous shale other than those mentioned in § 2 (1) (16) or (23) or installations for the production of lubricants from crude oil; 3) installations for the briquetting of hard coal or lignite; 4) 1(3), with a heat output, understood as the amount of energy input in fuel to the installation per unit time at the nominal load of these installations, of not less than 25 MW, and when using solid fuel - of not less than 10 MW; 5) hydroelectric power stations; 6) installations using wind power for electricity generation, other than those mentioned in § 2 (1) (5): a) located in areas covered by forms of nature conservation referred to in Article 6(1)(1) to (5), (8) and (9) of the Act of 16 April 2004 on nature conservation (Journal of Laws of 2018, item 1614, 2244 and 2340 and of 2019, item 1696 and 1815), excluding installations intended exclusively for the supply of road and railway signs, road or railway traffic control or monitoring devices, navigation signs, lighting devices, billboards and advertising boards, b) with a total height of not less than 30 m; 7) overhead power lines with a voltage of at least 110 kV other than those specified in § 2 section 1 item 6; 8) radiocommunications, radionavigation and radiolocation installations, other than those specified in § 2(1)(7), excluding radiolinia, emitting electromagnetic fields with frequencies from 0,03 MHz to 300 000 MHz, in which the equivalent isotropic radiated power determined for a single antenna is not less than: a) 15 W and the locations accessible to the public shall be within 5 m of the electrical centre line of the main radiation beam of that antenna, b) 100 W and the locations accessible to the public shall be within 20 m of the electrical centre of the main radiation beam of that antenna, c) 500 W and the locations accessible to the public are within 40 m of the electrical centre line of the main radiation beam of that antenna, d) 1000 W and the sites accessible to the public are no more than 70 m away from the electrical centre of the main radiation beam of that antenna, e) 2000 W and the locations accessible to the public are not more than 150 m and not less than 100 m from the electrical centre of the principal axis of the radiation beam of that antenna, f) 5000 W and the locations accessible to the public are not more than 200 m and not less than 150 m from the electrical centre of the main radiation beam of that antenna, g) 10 000 W and the sites accessible to the public are located at a distance of not more than 300 m and not less than 200 m from the electrical centre of the main beam of that antenna - whereby the equivalent isotropic radiated power shall be determined for a single antenna also in case another radiocommunication, radionavigation or radiolocation installation is or has been installed on the same site or facility; Official Journal - 7 - Item 1839 9) radioactive waste treatment or storage installations other than those mentioned in § 2 (1) (8) (b) and (e); 10) iron ore roasting and sintering installations other than those mentioned in § 2 (1) (12); 11) Installations for the processing of ferrous metals: forges, foundries, rolling mills, drawing mills and installations for the application of metallic coatings, other than those mentioned in § 2, paragraph 1, item 13; 12) installations for the secondary smelting of non-ferrous metals or their alloys, including refining, casting or processing of recycled metals, other than those mentioned in § 2 (1) (14); 13) installations for surface treatment of metals or plastics using a chemical or electrolytic process, other than those mentioned in § 2 (1) (15); 14) installations for the surface treatment of substances, objects or products using organic solvents, with the exception of modifications to these installations through the introduction of counter- feasible solvent recovery equipment into the process line; 15) Installations for the production of cement clinker other than those listed in § 2 (1) (17) and installations for the production of cement or lime; 16) installations for the manufacture or assembly of motor vehicles or production of engines; 17) installations for the construction or repair of aircraft; 18) installations for the manufacture of railway equipment; 19) installations for explosive extrusion; 20) installations for the production of bituminous mixtures; 21) installations for smelting mineral substances; 22) mineral fibre production installations; 23) installations for the manufacture of ceramic products by firing, with a production capacity of not less than 50 t per year; 24) installations for the manufacture of glass including glass fibre; 25) installations for cleaning, degreasing or finishing of fibres or textiles; 26) installations for tanning or refining leather; 27) installations for the production of paper or cardboard, other than those mentioned in § 2 (1) (19); 28) cellulose-processing installations; 29) installations to: a) elastomer production, b) manufacture or processing of elastomer-based products; 30) transmission installations: a) oil, b) petroleum products, c) substances or mixtures within the meaning of points 1 and 2 respectively of Article 3 of Regulation No 1907/2006 that are not foodstuffs - other than those listed in § 2 (1) (20); 31) installations for the transmission of gas, other than those listed in § 2, section 1, subsection 20, and the associated compressor or reduction stations, with the exclusion of gas pipelines with a pressure not greater than 0.5 MPa and connections to buildings; however, compressor or reduction stations constructed, assembled or reconstructed around existing transmission installations are not projects likely to have a significant impact on the environment; 32) installations for the transport of steam or hot water, excluding district heating networks and building connections; 33) installations for the capture of carbon dioxide for the purposes of underground storage other than those specified in § 2, subsection 1, point 53; Official Journal - 8 - Item 1839 34) distribution facilities: a) oil, b) petroleum products, c) substances or mixtures within the meaning of points 1 and 2 respectively of Article 3 of Regulation No 1907/2006 that are not foodstuffs - excluding service stations for liquefied or compressed gas; 35) underground storage facilities: a) oil, b) petroleum products, c) substances or mixtures within the meaning of points 1 and 2 respectively of Article 3 of Regulation No 1907/2006 that are not food products, d) flammable gases, e) fossil energy resources other than those listed in points (a) to (d) - other than those specified in § 2 ust. 1 pkt 22, excluding installations for the storage of fuels used for domestic purposes, liquid gas tanks with a total capacity of no more than 20 m3 and oil tanks with a total capacity of no more than 3 m3 ; 36) underground storage of substances without tanks; 37) above-ground storage facilities: a) oil, b) petroleum products, c) substances or mixtures within the meaning of points 1 and 2 respectively of Article 3 of Regulation No 1907/2006 that are not food products, d) flammable gases, e) fossil energy resources other than those listed in points (a) to (d) - other than those specified in § 2 subsection 1 point 22, with the exception of installations for the storage of fuels used for domestic purposes, liquid gas tanks with a total capacity of no more than 10 m3 and oil tanks with a total capacity of no more than 3 m3 , as well as non-distribution installations for the storage of solid energy resources; 38) installations for the processing of asbestos-containing products other than those mentioned in § 2 (1) (25); 39) mineral processing installations other than those mentioned in § 2 (1) (26); 40) opencast mineral extraction other than that specified in § 2(1)(27)(a): a) regardless of the size of the mining area: – in the case of extraction of peat or lake chalk, – on areas exposed to flood hazard within the meaning of Article 16 point 33 of the Act of 20 July 2017. - Water Law, and if a flood hazard map has been drawn up - in the areas referred to in Article 169(2)(2) and (3) of that Act, – on or within 100 m of forestry land, – on areas covered by forms of nature protection referred to in Article 6 (1) (1-5), (8) and (9) of the Act of 16 April 2004 on nature protection or in the buffer zones of the forms of nature protection referred to in Article 6 (1) (1-3) of that Act, – at a distance of no more than 250 m from the areas referred to in Article 113, section 2, item 1 of the Act of 27 April 2001. - Environmental Protection Law (Journal of Laws of 2019, item 1396, as amended.5) ), 5) Amendments to the consolidated text of the above-mentioned Act were announced in the Journal of Laws of 2019, items 1403, 1495, 1501, 1527, 1579, 1680, 1712 and 1815.
