There is increasing debate about the need for
other government officials to maintain a neutral appearance. In November 2017, the
Netherlands Institute for Human Rights determined that the Dutch police’s decision to
prevent female officers from wearing headscarves amounted to indirect discrimination on
religious grounds.37

pursued by the Government must be fully compliant with international law and the
Declaration on the Elimination of All Forms of Intolerance and of Discrimination Based on
Religion or Belief, including provisions for religious groups to maintain charitable and

Conditioning the free and peaceful exercise of freedom of religion
by Muslims, which includes the right to construct and maintain places of worship, on the
behaviour of an extremist minority within Islam (whose words might as well merit criminal
prosecution as incitement to hatred or violence, but do not represent the views of the
majority of Muslims) is unacceptable.

attention, it is all the more important to maintain a sensitive approach that avoids putting
