Deprivation of liberty on the grounds of disability or mental health condition9 48. The Working Group learned that placement of individuals in hospitals and treatment facilities on the basis of a psychosocial disability or a mental health condition, such as schizophrenia, bipolar disorder and depression, is increasingly common in post-conflict Sri Lanka. (...) Around 8,000 persons are admitted to the National Institute of Mental Health (Angoda) each year for treatment. (...) While the Working Group welcomes the commitment of the National Institute of Mental Health to prioritizing community-based support, wherever possible, this appears to be a very limited practice.

GUIDELINES ON JUSTICE FOR CHILD VICTIMS AND WITNESSES OF CRIME : REVISED DRAFT RESOLUTION / CANADA, CROATIA, GHANA AND PORTUGAL
The Guidelines should also be applied to processes in informal and customary systems of justice such as restorative justice and in non-criminal fields of law including, but not limited to, custody, divorce, adoption, child protection, mental health, citizenship, immigration and refugee law. (...) This includes but is not limited to the following: child and victim advocates and support persons, child protection service practitioners, child welfare agency staff, prosecutors and defence lawyers, diplomatic and consular staff, domestic violence programme staff, judges, law enforcement officials, medical and mental health professionals, and social workers; E/CN.15/2004/L.7/Rev.1 7 (c) Justice process encompasses detection of the crime, making of the complaint, investigation, prosecution, and trial and post-trial procedures, regardless of whether the case is handled in national, international or regional, adult or juvenile criminal justice, or in customary or informal systems of justice; (d) Child-sensitive denotes an approach which takes into account the child’s individual needs and wishes. (...) Where possible, costs of social and educational reintegration, medical treatment, mental health care, and legal services should be addressed.

The Working Group met with officials of the following ministries: Foreign Affairs; Home Affairs; Health; and Gender, Family and Social Services. (...) Giving drug-dependent persons a choice between being incarcerated and undertaking rehabilitation does not serve as an incentive to improve their health, only to avoid prison. VISIT TO URUGUAY :REPORT OF THE INDEPENDENT EXPERT ON THE ENJOYMENT OF ALL HUMAN RIGHTS BY OLDER PERSONS
On 24 August 2017, Uruguay passed Act No. 19529 on Mental Health. Despite the efforts of and the dialogue facilitated by the National Commission for a Mental Health Law, a group of civil society organizations, the new law fails to incorporate a human rights-based approach. While it provides for the establishment of a national mental health-care oversight commission, the Commission for the Control of Mental Health Care, it does not provide for that commission to have a sufficiently independent status. This hinders the commission’s ability to monitor the level of respect of patients’ human rights at all levels and to impartially review involuntary admissions, and thus contradicts the Principles for the Protection of Persons with Mental Illness and for the Improvement of Mental Health Care.
