It was mentioned that the fact that MONUC is jointly heading the working group on protection might have an impact on the ability of the working group to take independent decisions in relation to advocacy. (...) Protection in the context of the search for a durable solution 59. In keeping with Guiding Principle 28, which is cited in the Great Lakes Protocol on protection and assistance to internally displaced persons, the authorities have the duty and responsibility to establish conditions which allow displaced persons to return voluntarily, safely and with dignity, or to resettle voluntarily in another part of the country.

The Special Rapporteur considers that the situation requires urgent attention and solution-oriented actions in order to allow these communities to finally rebuild their lives. (...) Issues were also raised with regard to the equity of providing the same housing to all islanders whose homes had been destroyed, irrespective of whether they had owned it, or the size and type of house they had owned in the past. 48. A compromise solution seems to have finally been agreed and at the time of the country visit, it was expected that the housing reconstruction would be completed within the space of one year. (...) According to the Framework on Durable Solutions for Internally Displaced Persons, a durable solution to internal displacement is achieved when “IDPs no longer have specific assistance and protection needs that are linked to their displacement and such persons can enjoy their human rights without discrimination resulting from their displacement” (A/HRC/13/21/Add.4, para. 8).

In Uruguay, a sewage system has traditionally been perceived as the ideal (if not the sole) solution as regards assuring access to sanitation. (...) Eight years before the adoption of the above-mentioned resolutions, the Committee on Economic, Social and Cultural Rights had defined the legal basis of the right to water as “entitl[ing] everyone to sufficient, safe, acceptable, physically accessible and affordable water for personal and domestic uses. (...) The Special Rapporteur was informed that, in 2010, only 47.12 per cent of the water was invoiced; 52.80 per cent was unaccounted for, and not charged.22 Among some of the reasons why water is unaccounted for, OSE mentioned water leakages due to pipes that were in poor condition, but also illegal water connections.

Forced intercourse was mentioned as the most common act of sexual violence. 10 per cent of the women interviewed experienced sexual abuses as children, most frequently alleged to be perpetrated by family members (stepfather, father or other male family member) and male friends of the family. (...) Numerous interlocutors mentioned the re-emergence of traditional, patriarchal beliefs and practices since the independence of the country. (...) The Azerbaijan National Human Development Report 2007 revealed that 48.7 per cent of women mentioned their insufficient economic resources as a reason why they chose not to seek medical treatment.33 The issue of widespread corruption, particularly affecting State institutions, was repeatedly emphasized during the visit as one of the scourges of Azerbaijani society, and was highlighted as a major obstacle to equal access to all State services, including the education and health sectors. 44.

The Government of Spain is firmly committed to seeking practical, consensual solutions within the procedure established by law that will enable a response to be made to the problems created by these minors. In some cases, the solution will involve family reunification and repatriation to the country of origin, with the guarantees provided for in the above-mentioned procedure.

Specifically on combating hate speech against Roma in the media, it should be mentioned that the Bulgarian Government has co-financed the Public Roma Debate – an event co-sponsored by the NCCEII, the Open Society Institute, the National Association “Debates”, the newspaper “Drom Dromendar” and the “Red house” - Center for culture and debates. (...) The Bulgarian Government confirms once again its political will for the improvement of the situation of Roma, while also fully acknowledging that there could be no simple or quick solution of these issues. The full-fledged integration of Roma is a matter of enhancing social inclusion and fair distribution of the burden of responsibilities. (...) Meetings are also held locally with official representatives and informal leaders of the Roma community aimed at improving awareness and promoting employment. 8. As already mentioned above, the competent authorities do react immediately, enforcing the relevant legislation, in any cases of violence on ethnic or religious grounds.

Under that policy, asylum seekers who arrived by boat were transferred to offshore processing centres in Nauru and on Manus Island in Papua New Guinea, where they were detained while their asylum claims were processed. (...) Increased violence from the guards, especially during transfers, such as systematic handcuffing, aggressive language and brutalities that did not exist before, were also regularly mentioned. Violence among detainees has also increased.
