REPORT OF THE REPRESENTATIVE OF THE SECRETARY-GENERAL ON THE HUMAN RIGHTS OF INTERNALLY DISPLACED PERSONS, WALTER KALIN : ADDENDUM
In all parts of Bosnia and Herzegovina, forced displacement was deliberately used by the warring parties to create ethnically homogeneous areas, which constitutes a crime against humanity now commonly referred to as “ethnic cleansing”. At the end of the conflict in 1995, more than 2.2 million persons, i.e. almost half of the country’s E/CN.4/2006/71/Add.4 page 8 inhabitants, had been uprooted. (...) Also, contrary to Annex 7 to the Dayton Peace Agreement, political institutions at entity, cantonal or municipal level refrained from supporting minority returns or even opposed them actively with the aim of maintaining or continuing “ethnic cleansing”. Although substantial financial aid to assist and sustain returns was available at the time due to the international community’s focus on return, the political will to use it was missing. 15. (...) In Bosnia and Herzegovina, the international community through the Dayton Peace Agreement has clearly prioritized return over local integration in order not to legitimize “ethnic cleansing”. Returnees are entitled, according to guiding principle 29, to be protected against discrimination and to recover their property or to receive compensation for lost property. 34.

REPORT OF THE UNITED NATIONS HIGH COMMISSIONER FOR HUMAN RIGHTS AND FOLLOW-UP TO THE WORLD CONFERENCE ON HUMAN RIGHTS :ADDENDUM
The State’s inability to ensure and guarantee the right to life was evidenced in various ways, among the most serious of which was the persistence of what is commonly known as “social cleansing”, observed inter alia through bodies being found showing signs of torture and subsequent execution. (...) Nevertheless, the circumstances in which these crimes are perpetrated, and the profile of the victims, indicate that “social cleansing” is being practised, sometimes under the direct or indirect responsibility of State officials. (...) The office draws attention to the fact that these acts of “social cleansing” often encounter acceptance or indifference among various segments of society, including the authorities themselves.
